✎ EN American move-Marrying and working in the UK

    Hi everyone! I am at my wits end right now trying to decide the best plan of action. I have gone through several threads here trying to get accurate info on specific questions and was hoping for some help and not wanting to repeat any other previous threads. I have similar questions, but more thorough info is still needed. :confused:
    Here is my problem...I am in love and impatient to finally marry my Brittish fiannce'. We have been together for 16 months, he has been to the US to see me a couple times, and I have been to see him in London in December/January this year. We survive our separated lives via Skype video, but we have wanted to marry in the UK and to remain together always. Our plan was for me to move to London with him and marry in the Lake District in November. I have tried to get more info online on visa's,working, and the legal issues involved and have found conflicting info so far. I would like to move over with him ASAP, but my concern is about which visas to get,financially supporting myself, and how to best accomplish our goal. I thought that if I come over to him on a fiance visa (he has a job and flat and would never live on public funds), I could get working until we marry. What I have found is that I cannot work for 6 months once I am there? He is expected to fully fianancialy support me this whole time? What kind of garbage is that? I planned on leaving the US by April to begin our life together in the UK. How is the fiance visa able to impose a requirement of not contributing to the financial health of a relationship? I work in healthcare and am very able to work, but would not be allowed to for 6 months? Help please!! :(

    The FAQ on the Fiance visa tries to lay out the guidelines plainly (http://www.easyexpat.com/en/faq/departure/q81.htm)
    "People who are planning to marry a British citizen or permanent resident in the UK may apply for a fiance/fiancee visa.

    Fiance/Fiancee Visa Requirements:
    # The sponsor and the applicant must intend to get married within a six month period.
    # They must have met each other.
    # They must intend to live together permanently.
    # The applicant must be able to support him / herself, or be supported by their partner, without access to public funds.
    # There must be adequate accommodation in place.
    # There is no requirement that the applicant and the sponsor have lived together before applying.

    Successful applicants receive a 6 month visa in which to come to the UK and get married. They are not allowed to work while on this visa. Once married, the recipients must apply for a marriage visa."

    So yes- you may not work on this visa. If you are married and qualify for the marriage visa, it appears you are eligible for work. http://www.easyexpat.com/en/faq/departure/q82.htm

    "This visa is for people who are married or in a civil partnership with a UK citizen or permanent resident. UK citizens and permanent residents are able to sponsor their spouses or partners for a marriage visa. Dependent children can also be included on Marriage Visa applications.

    Marriage Visa Requirements
    # The sponsor and the applicant must be legally married or in a civil partnership
    # They must have met each other
    # They must intend to live together
    # The applicant must be able to support him / herself, or be supported by their partner, without access to public funds
    # There must be adequate accommodation in place

    Once the visa is obtained, (if the marriage is less than 4 years old) there will be given a 2 year visa to live and work in the UK or or (if Applicants who have been married and lived together for 4 years or more) they may be granted Indefinite Leave to Remain."

    Is it possible to marry before your move? Hopefully this helps to clarify

    I just want to be with him over in the UK, and we are getting more impatient to be together every day. I think it may be easier for him to come here to the US and we marry, then try for the marriage visa. I don't know how long that would take for approval, but the sooner the better. Ideally, we hope that I can get approved for it and for me to be heading back to the UK with him within a week or so of us being married. If we could do this, then I need to know what he needs and I need to give the border agency (I believe is the correct people) to expedite my spousal visa. I don't think he needs much for marrying me in the US...just his passport, and traveling visa, and proof of divorce from over a decade ago. I miss being able to hold him very badly, and he wants me there by his side just as badly. Everyday we are apart breaks our hearts. Thanks for the help!

    Hi there,

    I am getting married in 2 weeks to my English muffin.. I have posted back and forth concerning the settlement visa process. You need to make sure you read the details for the visa entirely. The link above are a great way to start. Here is a link on the thread where i posted a lot of useful information. good luck! It's a lot easier to do this in the states than in England, but you can't do much on expediting. It can take up to 120 days for the visa to process, but apparently most people get it within the first month or so. I put up a time chart on this thread below. Good luck!
