✎ EN In UK, my fiance is Pakistan and now he's there without VISA

    I have question what we have to do and what chance we have to be together?
    im Polish work in UK, my fiance is Pakistan and now he is there without any visa, we try getvisa for invite to Poland to spend holiday and get merried then we wanted decide where go to UK or Sweden, but everything change by one night and now we need help
    this is true if we get merried in Pakistan we registry our merrige there and i have job in UK he has right to came to me live with me with any problem, because i hear about some dokuments and i think this is EEA dokuments or some WRS could you help me give advive what step to make?
    Because im europen and if he get merried wth me he get some right to be with me,just i need registry this in UK and how long this can take?becase in embassy where we applay for visa to Poland make lot of problem becase we are not merried and only one way to be together go there ger merried and came with him

    please help

    Unfortunately as your boy-friend / fiance is illegal in UK so there is no way he could get a visa for UK or Poland with this status and you also can't get married in UK because he is a non-EU citizen so he will need a Certificate Of Approval from Home Office before he could marry you. The only way out for you guys now, as far as I know, is that your fiance goes back to Pakistan and then gets fresh visa to come back. Here I will suggest, he should go to Pakistan and apply for a Polish visa because that will be much easier on the basis that you could send him an invitation from Poland. Getting a visa for UK will be very tough even if you go to Pakistan and you both get married there. He will have to comply with all the usual immigration regulations and just because you will get married, is not going to change anything.

    we get merried in pakistan, and we registry merriege there and i registry merriagein poland too, now im working in uk and registry merrege here becasue i here that way i can go to him and then we can applay for family visa and is law that family have to be together so i believe that this will be work to poland is very difficult get visa they make you terrorist and me lier if i want visa telling me get pregnat with him this is not profesional!!!so we choose this option i here people make that or may be you know diffrent way for us as u see something change that we are merriage and this is registry in two country....please for help i here to that if somebody from uk invite him is easy to get visa

    I think you can have three solutions here.

    1. You can go to Pakistan and get married and the EU law says that your husband will be able to get a visa to UK which is called EEA Family Permit
    but the problem with this visa is that you will have to provide a lot of documentation for example police clearence, health insurance, references, and the most important, you will have to show a lot more money in your application as the means to suport yourself and your husband. Another problem is that in Pakistan it will take a lot of time to get such a visa. You should remember that you are not a British citizen so your husband cannot get a normal family visa but only a special type of visa called EEA Family Permit which is only for six months.
    Another problem here is that your husband has over-stayed in UK which can be a negative point for future visa applications. So please make sure that if he is asked in the British Embassy about it, he doesn't lie because now the British embassies are using biometric data and any previous visits to UK can be easily traced.

    2. The other solution is that you both get married in Pakistan, register your marriage in Pakistan and then apply for a visa to Poland for him. I am not sure if you can register your marriage in Poland while you are in Pakistan because as far as I know, Polish embassies do not register marriages of Polish citizens abroad. Once you and your husband come to Poland, then you can apply for an EEA Family Permit for him which will be a lot easier to get than in Pakistan and you both can go to UK. Also, getting a visa for Poland will not be a problem after you both are married.

    3. The third and simple solution is that your husband goes back to Pakistan and apply for another visa to UK. Here I should tell you ( even though I am not sure about it ) that he should not get a visit visa because on a visit visa, he can marry you but he can't get a working visa for UK because visit visa for UK is not changeable. So I will suggest he gets a different kind of visa.

    I understand your husband is in Pakistan.

    As you are an EU citizen, your husband should get a free visa at once to be able to join you overthere.

    No proof of income necessary.

    Even if he manages to enter the plane without any visa (which I doubt) he should be let in in any EU member state. According to the BRAX/MRAX ruling of the EU court.

    Unfortunately, the above is the theory.

    Do let him file the proper application and take steps to get help form the European Comission if they refuse him.

    Should you want to come to The Netherlands, I can help him with the visa problem. Even if the Duch embassy initially refuses, we have a proper and almost free legal system to garantee him his European rigts.

    Poland however would apply its national law, unless you can prove your stay in the UK.
