    Hi there, I hope you can help me with my query. I am a Non-EEA national with my wife who is an EEA-National residing in UK holding EU resident permit. We were issued the residence permit in June 2001 and we are nearing our completion of 4 years by when we can apply for Indenfinite Leave to Remain in the UK. We both have been employed on and off , my wife being more off than myself. Hence we have 3 P60s for me and 1 year where I worked some part of the year which can be validated by inland revenue. My wife on the other hand has 2 P60s and she has been working for some part of the other 2 years. The reason for her gap in UK employment was that we were planning to start a business and she was involved with the research and setting it up. We have the Certificate of Incorporation for that business showing our 2 names as directors but we never got it off the ground due to general business and economic conditions (9/11 Twin tower incident in 2001 etc). My question is what documentary evidence do we need to provide to them in the absense of P60s highlighting that my wife as an EEA national was exercising treaty rights as self-sufficient. We did have private health insurance for most of these 4 years, what else would we need to provide to HomeOffice for our application. Any help on this would be greatly appreciated as we are in the process of gathering the right documents before we apply next month? Thanks

    Your Company Certificate of Incorporation should help. Apart from that evidence proving that you have been living in the counry without being absent for 2yrs will help. Under EU Law your Permits can be terminated if you have been absent from the country for a continuos period of 2 years. Evidence to prove otherwise include rental contracts, children's official documentation, bills, etc.

    Also if you have been a Public burden on the Social Security system for a considerable number of times, this could also affect the grant of an ILR. I advise you cover all grounds before putting in for the request.

    Thanks for your reply. What do you mean by being a public burden on the Social Security system? Do you mean claiming benefits from the Inland Revenue, if so we have not claimed any and we have had personal Health Insurance for most of the 4 years?
