✎ EN Spouse VIsa

    Hi, im polish, my husband is brazilian, he is in uk for almost 4 years now, his visa with work permit is finishing in february 2011, instead of applying for next few year work permit we want to apply for spouse visa, as we want to buy a house and nobody is willing to give us a joined mortgage.
    The question is, how can we apply? Should we just send our papers to the home office, get the solicitor, how long does that usually take and how much would it be? Does it matter that i will have a baby any time now, so i dint work and he is the only one making money in the family? Please help me out!!

    Since you are a Polish national, you cannot apply for Spouse visa. Depending on your own situation, you can apply under EEA regulations.

    If you have worked one year under WRS scheme ( doesn't matter if you have a registration certificate or not ), your husband can apply for EEA2. Otherwise for FMRS.

    However, if its only your husband who is earning, you can still apply for EEA2 under the Self-sufficient category. Make sure you get a provate comprehensive health insurance for both of you ( and the baby too of course ).

    One more question, if i have worked for over 3 years under wrs scheme i dont have to have registration certificate? I called home office today and she said that i dont, but on the eea2 for my husband it says i do.. Im confused.
    He has 6 months left on his current visa, so i dont have time to apply for eea1, as they say to give them around 6 months to apply for eea2, should i just send them my pay slips or can we apply for both at the same time?
    I will be grateful if you can help me out with that! Thank you so much
