✎ EN Marriage with an expired Schengen Visa?

    Can someone kindly explain to me Fiance & I if there are any possibilities marrying -as it appears my Schengen Visa-extension may be denied soon. It would seem silly, and expensive, to have to leave the Schengen states for 90 days, then return to finally join my new prospective family because we're getting married regardless.

    Does anyone know of any legal strategies here? Hint: I was born in France but of American parents, she actually proposed to me almost 11 months ago (she is the one wanting to marry me). I have recently found my original French Birth Cert. but I'm not sure what to do with it yet.

    Any helpful comments & advice we would greatly appreciate.

    I am a bit confused by your situation. You are an American citizen and they hold a passport of a Schengen state? What country are you in now?

    In the long run, it may be to your advantage to try to establish French citizenship if possible since you say you were born in France. The guides on the left hand side of the page should be of help to you. They are guides for becoming a successful expat and include a section dedicated to visas.

    Thanks sincerely for your reply.

    Sorry for any confusion; I have a US Passport, I had a one-year Schengen work-Visa, it expired -but I applied at our local City Hall for a Visa-extension (per recommendations of our Ausländerbehörde), and that Visa-extension is not yet 'denied'.

    So if I have any application 'pending' can I be basically safe to assume I am not Officially Overstayed (unless I don't leave after I am denied)?

    As far as obtaining a French citizenship (which I would really, really appreciate), it seems basically impossible because of the year I was born, and my parents were American (according to a French Consulate in the US). But, my US Passport says I was born in France and I have recently found an Official copy of my French birth record in France. Do you have any idea how this could work?
