EEA2 Application Question

Postby motionworks » Sun Apr 26, 2009 8:35 pm

Hi Everybody,

I am a Turkish citizen who lives in France for 3 years. I am married with a French citizen. I have a valid resident permit in France. I am economically active for 2 years in France. I am self employed.

We decided to move to London. We applied for VAF5 visa for EEA2.
Then 1 weeks later i got my visa.

We will go to London 1st of May 2009 for 8 days to rent a flat. Then we will back to France and move our house to London. Then we will apply for EEA2 Resident Card to Border Agency. So far it was smooth.

After reading lots of stories about waiting for resident card for more than 6 months, we are shocked. So i have a few questions about this.

1.) At the end of this process, is there any possibility to get a rejection ?
If i get a rejection what will i do ? I will move my house to London !!!

2.) My EEA member wife will not work in UK. I will move my current work to London. Because my work is location free. I create motion graphics for an international company (Getty Images and iStockphoto). Here is my question, can i work with Certificate Of Application ? And is it problem if my wife doesnt work in UK.

3.) And final and classic question, if i apply in June, what is the estimated time ?

Thank you so much

Hi Yucel

Until such time as you application has been decided by the Home Office, you will be treated for immigration purposes as a family member of a legally resident EEA national and, as such, you are free to live and work in the United Kingdom.

If you can provide sufficient evidence that you can support yourself financially your wife would not need to be employed. You would have to provide bank statements and have sufficient savings. You would also need to provide proof of being self employed.

It is very unlikely that your application will be rejected, especially if you have been married for longer then 2 years.

The bad news is that you might have to wait a very long time for your passports to be returned after you send them to the Home Office. At least 9-12 months.

Good luck.
