    Hi All,

    My fiance was refused a student visa in 2011 (and might have incurred a ban) and we decided to settle down in his native Nigeria instead.

    I decided to relocate from London to Lagos, Nigeria in Dec 2011, and we have been living together since I came to Nigeria.

    We got married in June 2012 in Lagos.

    I would now like us to have the freedom of movement as a family, and thus I was advised that we should apply for EEA permit.

    My husband is a Nigerian citizen and I have dual nationality - Polish & British.

    Kindly advice me on the best approach to assure my husband is granted rights to travel and work in UK and EU.

    Someone advised me on EEA permit (since I have Polish citizenship) and others say I should go for UK spouse visa. However I am not currently living in the EU or UK, we are both residing in Lagos since Dec 2011.

    We are both professionals, and prior to moving to Nigeria, I was on a GBP53,000 gross salary and have a letter form my then employer, Royal Bank of Canada, confirming this.

    I never claimed benefits and have no intentions of doing so in future.
    We just want to be able to live, work and travel and not destine our future based on immigration restrictions, which in our case can be avoided.

    A good place to start is with the Guide to London's section on UK visas, as well as our article Obtaining a Visa to Live, Study and Work: the United Kingdom. Some of the differences between the EEA permit & Spouse visas are also explored in our FAQ.

    First of all, you should certainly try to establish if there has been a ban placed on our spouse as that will greatly affect your chances. Consult with the British embassy in Nigeria: http://ukinnigeria.fco.gov.uk/en/ They can also offer you complete information about what you should apply for and requirements. I would also recommend consulting with an immigration attorney. This can be a pricey option, but a good lawyer can offer you the information you need to successfully apply.

    Has anyone else been through this experience and can offer advice? You can try searching the forums for other users experience applying, as well as contact expats through the network in the UK, and even talk to other Nigerian expats living in England. Best of luck!
