I suggest eu national must write to mp this letter, i did this, didn't get reply yet. Maybe it will
be helpful to other people in same situation. I
reckon that uk border agency do to eu national spouses is highly criminal matters. Would be very interresting to know what other mps in uk thinking about it.

British government continually breaching european convention on human rights persecute and humiliate spouses eu nationals.

I’m eu national. My spouse non eu national arrived to uk at 14.08.09 with eea family permit visa. Two weeks before visa was expired she applied for residence card, she sent her passport, my id, application form eea2 and evidence that i’m exercising treaty rights to uk border agency.(ukba)

two month later at 05.03.10 we received from ukba all documents back with attached request letter to supply additional documents; “evidence of exercising treaty rights dated during last six weeks”, besides date on request letter was 13.01.10 six weeks later then we actually received all this documents.

I believe that not me not my spouse must not supply to ukba any additional documents, their request and hampering issue residence card on grounds of this request is unlawful.

As right of eu national spouse live in uk is deprived from the family ties only,

ukba may require spouses of eu national applying for residence card to present their valid passport and a proof of family ties. No other documents, such as a proof of accommodation, sufficient recourses, evidence of exercising treaty rights, deposit, cv, references, can be requested.



Seems to me that british government do not want issue residence card to my spouse, maybe would be expedient refuse to my spouse issue residence card and we would think what we have to do, appeal against refusal or go to live somewhere else. Vagueness with respect to us is injuring us greatly. Fact is that my spouse during two month stayed in uk without her passport and three weeks ago she received her passport without proof that she stay in uk legally. That means that theoretically, since she is spouse eu national she has rights same as eu national, but practically she do not have any rights at all, because majority government and private organisations in uk, and potential employers do not count person foreign nationality as existing person if one do not have a passport, same as person do not counted as existing person if one have passport with expired eea family permit visa.

Ukba deprived my spouse her right apply for a job, go to study, open bank account, register to gp, and enrol to library and other things. Ukba took away possibilities from my spouse use her rights as eu national spouse.

This is humiliating, british government turn my spouse from free person in her home country into slave without any rights in uk, discriminate and isolate my spouse through policy of enslavement.



I would like to clarify position of british government with respect to spouses eu nationals, if me and my spouse do not supply evidence of exercising treaty rights, references, deposit, cv and so on, does it mean that uk residence card to my spouse will not be issued?

And if it will be issued, is it normal to freeze rights spouses eu nationals on time of application proceeding?

And if it will not be issued on the grounds that we did not supply evidence of exercising treaty rights, references, deposit, cv and so on, does it mean that spouse eu national will be stay in uk indefinite without residence card until she will supply ukba required additional documents?



If for instance i will call to uk inland revenue office and ask them something, first they will ask me security questions and their first question will be: where did you work last time? Even if i was working two days ago they already have this information in their computer, where i was working and how long. If i will tell them wrong answer they will not going to talk with me. Therefore i reckon that ukba fool around and have returned documents to my spouse with request to supply evidence exercising of treaty rights not because they really need this evidence, but with one intention only to complicate everything and engage with ping pong special delivery parcels at our expenses with our documents, with hope that our id’s will be lost one day or other in order to fulfil british government policy enslave as more people as possible and create layer of slaves which theoretically have rights, but practically do not have any rights at all.

Congratulations! I myself also applied for an EEA2 residence permit which is valid for 5 years. I got married in France. I initially received the COA indicating my right to work and reside in the UK 5 weeks after I sent the application- again, much quicker than I expected (note that I am a non-EU citizen).

My problem is that my passport was lost by Royal Mail after it was being sent back to me by another government body and now I'm not sure what to do. From what I've learned, you have to report that it was lost and then apply for a new one. The problem is, the permit was in my passport so I can't apply for a new one without that passport (or am I missing something?)? Can I apply for a new residence permit without a new passport? My embassy says it will take 2 months to renew which means I'm stuck without a passport and residence permit. The job agencies I have approached are wary of proposing my CV to companies because they haven't seen my original passport and stamp. I have provided a copy of my old passport (forgot to photocopy my residence stamp before it got lost), and showed them the my COA and the letter I received from the UKBA confirming my status (although the letter just says that my rights to remain in the UK are only valid while my spouse legally resides here and doesn't specify my residence permit validity, etc.).

Does anyone know how I can go about convincing these agencies of my status while I'm waiting for replacement of all my documents? I already told them to call the UKBA hotline indicated in the COA and provided all sorts of copies of my identity such as my old passports, my bank cards, my foreign driver's license, etc.

 

Help please, I send my EEA application on October 2011 and after 6 month the ho send my application back because my passport expired and I renw it and I send it again in march 2012 and after a month the send me a paper that I can work and till now I didn't hear anything yet and my Lwayer is shit anyway and now my wife book a holiday to her country but our passport still at the ho .. I need to know can I go to the ho and see what happened!!!! and if they send me my passport the case will be keep running or they will stop it or what??? Many thanks

 

You can't go in person to the Home Office to see what's happening, they won't let you in. If you ask for your passport back then that can terminate the application. You really need a decision.

Start with your lawyer: phone him or her, and ask them to contact UKBA in writing to find out what has happened and send you a copy of the letter.

Once you have the letter that your lawyer has sent, go to your MP, show it to them, and ask your MP to intervene.

It's at this stage that you usually get a result although it does take a few weeks.

If your lawyer won't write a letter to UKBA or won't send you a copy, make a complaint to your lawyer and then go straight to your MP.
