    Hello, I am a Lebanese doctor and my wife is Lithuanian. I have a job offer at xxxx hospital in Wales. I applied for a FP to the UK the first time and made a dumb mistake mentioning that I will be travelling alone without my wife and child. Of course it was refused. I reapplied after 2 weeks and this time provided all necessary documents that my wife will accompany me (itinerary, letter from my wife, and hospital confirmation that a residence was booked for me and my wife). However this time the application was refused again. The text was as follows:

    In your last application you stated that you have been offered a job at xxxxx hospital in Wales and that your wife and son, who are Lithuanian nationals, will join you later in the UK. I note that having been refused as the officer was not satisfied that your wife will not accompany yourself you have now submitted a letter to say that your wife will accompany you but I am not satisfied that this is the case. If you intend to come to the UK you must apply under the correct category where your application will be assessed under the Immigration Rules once the specified fee has been paid.

    I didn't understand why my application was refused this time, is it because the ECO thought I was lying? Can he do that? Shouldn't he rely on the documents infront of him? My wife was really going with me, we made all the arrangements for that. Now I am going to miss my start date and ask the hospital to delay it until I find a way to resolve this issue. Am I ever going to get a FP? Please advise me what to do. I know I can appeal but it will take more than 8 months to process. I really need an advice. Thank you

    Thank you for the information but I have gone through every bit of the UKBA website so I know all the details about EEA permit, I am sure the ECO had no right to refuse the application unless someone knows a reason which is not mentioned on the website, and any advice on what other options do I have, should I reapply for a FP or apply for a work visa? any experience in this area would b3 appreciated.

    Hmmm it looks like the officer had the suspicion you were lying indeed.
    You can refer to the current EU law, and even their UK website. Your wife should also take care of the paper work, write supporting documents and explain arrangements in the UK. It si worth appealing. But in order to increase your chances of doing the right thing I would strongly advise to consult a proper immigration lawyer.
