✎ EN EU Citizen Marrying a Kuwaiti National

    Hi

    I am a Portuguese national, I have been living in the UK for the last 20 years. I want to marry my Kuwaiti girlfriend, we have been together now for over one year.

    What do we need to do?
    After she marries me, is she allowed to remain in the UK with me?
    What certificates do we need?

    Can she apply for a Portuguese ID or passport?

    I would very much appreciate your replies.

    Are you working in the UK?

    If you are (or if you are studying, or self-sufficient) then after the marriage she can apply for an EEA residence card. That will give her five years residence as your EEA spouse. At the end of it she can apply for permanent residence, and one year after that, for British citizenship.

    If you are NOT working in the UK, but have at some stage worked a consecutive five year period, then she can apply for further leave to remain as your spouse. However you would then have to show that you meet the minimum income requirements and that she is in the UK legally.

    So it is easier (and also much cheaper, since the EEA route carries no Home Office fee) if you are working, whether that's full or part time, as that would entitle her to remain here without a minimum income requirement and without so much hassle and expense.
