    Hello,

My husband and I are moving to the UK next year, with the intention of staying several years (for work).
We are both Australian Citizens. I am Dual Australian and German and my Husband is Dual Australian and British.
I am wondering if I might be better off applying for a spouse (of my husband) visa, or is it a no-brainer that I enter on my German passport?
Just thinking that since we plan to stay in the UK, will a spouse visa give me different / better entitlements than being an EEA national? Or is it the same and just be a waste of money?

The FAQ section offers information on visas and more.

    UK Marriage visa:
I don't think the advantages are that much different. Anyone else have information/advice?

Thanks for your reply. I am tending to agree.

I have been doing some more reading and I think for all intents and purposes in my situation a spouse visa is kind of redundant.

It also does mean extra cost- 826 Pounds for the application, then I have to get proof of our marriage, living arrangements etc... I think I would be crazy to bother if I have the option of walking in and just getting a residency card!

Not worth the cost and hassle!

No-brainer - oddly enough an EEA passport gives you better rights than as the spouse of a UK national! As a spouse you are 'attached' to your husband but with your own EEA passport you have an independent right of residence.

Also you can still acquire permanent residence after 5 years of living here as an EEA national, so there is no difference at all in your route to settlement and / or citizenship if you are collecting nationalities!

Yes I see exactly what you mean. All further documentation relating to permanent residency, NI numbers, tax, employment, coming and going, etc... will all be tied back to my husband and have to involve him all the time.

I would be much more independent living as a German.
