    Hoping someone out there can help me out with some advice. I came to the UK 4 years ago on a family permit as the spouse of a Swiss national. The marriage has now ended we have a 3 year old daughter together who was born in Scotland. I have been in work for 3.5 yrs in a permanent position.

    What are my rights , can i be sent back to south Africa or can i fight to remain in the UK for my daughter ?

    Since you have been married for more than three years and lived in the UK for more than one year, you are entitled to retain your residence rights. You will need a lot of help from your spouse though.
