✎ EN Partner overstayed visa

    hi plz can anybody help me n my partner have been together 3 years now we have an adorable 7 month old son mashallah we got reliougsly married(NIKKAH) just over a year ago im british my hubby is bengali but he has overstayed his work visa by 5 years :eek: what can we do so he can stay here in uk ith me and our son

    The two solutions I can think of are

    1 - Your husband goes back to his home country and applies for a spouse visa. Since he is married to a British citizen, his past immigration history wouldn't be taken into account specially when you have a lot to show your relationship is a genuine one and not just for immigration purposes.

    2 - You move out of UK to any EU country for six months, exercise your treaty rights there and come back so then he can join you via EEA law i.e. an EEA Family Permit which is even more relaxed than UK law.

    I am afraid it will be very difficult to sort his status out from within the UK unless you have money to spend on a good solicitor.

    we arent actually married by uk laws will we have to go to bangladesh to marry then apply if so how long do u think it will take? many thanks for your reply

    Sorry I missed that one. I thought you had registered your Nikah :oops:

    As for this question, thats entirely upto the ECO but it can be quicker if you subumit all the required along with sufficient supporting documents. The time it takes varies from country to country too so you can't be sure but I would provide three months to be on the safe side.
