✎ EN Bring my hubby to the UK with Work or Spouse Visa?

    Hello all !

    My husband and I are currently living on a US army base in Korea. In 2012, he will be getting out the army, and we're planning to start working and living in the US for another year (to secure money) until we plan our move to the UK. I am a British national, and my husband is not, so we were wondering how we'd go about getting him to good ol' endland.

    The line of work he's in at the moment is IT Security+, I'm going to be starting University in the next year or so... I thought about waiting until we moved to the UK to attend OU, but I'm scared they will reject our application if I don't have a higher paying job, and only worked as a Batista at a coffee shop, or a waitress; would this be true?

    My husband and I also talked about him finding a job in the UK, in his field of interest, and then making the move if he's able to secure a work visa. Once getting there, would we be able to change the statues of his visa, or, would it just be best to bring him over on a spouse visa?

    What do you think the best course of action would be? I'm scared he would get rejected if I had a low paying job and he had a higher paying one. Basically, depending on what answers I get will decide if I should attend an American online college (which aren't very good) or OU (which is). Plus, it'll help my hubby and I begin to get all the required documentation out the way. We're not looking for the fastest way to get his visa, but rather the safest. I've heard of pros and cons on either side.

    Also, are British visas usually granted, or is that just an open ended question?

    Thanks for all your help ! I'm really quite new to all of this as I came to the US as a teen, so I was rather quite ignorant about everything. :)

    You should definitely go for the spouse visa for your husband. How long have you been married for ? if its more than 4 years, that will make it even easier for him to settle down because he can apply for ILR as soon as he arrives in the UK and wouldn't have to wait.

    You earning less than him wouldn't have an impact on the visa application for example if you have a joint account to show that all of the money is available to you.

    For now, you can start collecting proof of your living together. Pictures, plane tickets for holidays, hotel reservations whatever you think would be useful in showing that you have been having a genuine marriage and not the one for getting him a UK visa - thats the most important question when it comes to getting a UK visa for him.

    We're coming up to our second year of marriage, and when he gets out the army it should be our third. We wanted to apply about a year or so after he got out, so we should be around the 4 year mark. Does it have to be 4 + years WHEN we apply or when we move?
