✎ EN Tier 4 switch to eea2 or FMRS ?

    Hello, please help me through this confusion !

    I am currently on a Tier 4 student visa, which expires in May.

    I have lived, studied and worked part- time in the uk for the last 18 months.

    My wife is an EEA national and has lived and worked in the UK for the last 14 months, but is not registered with WRS.

    We were married in the UK Dec 19th, 2009 with a certificate of approval. (1 yr, 2 months)

    Should I fill out the EEA2 or FMRS application to continue my right to work here in the UK ?

    I guess it would be more preferable to have EEA2, and it states in the guidance:

    "To apply for a residence card as confirmation of a right
    to reside as a non-EEA national family member of an EEA
    national who is exercising Treaty rights in the UK or for permant residence in this capacity"

    well, the truth is she is exercising her Treaty Rights.. but she is not registered under WRS, yet it doesnt say she need s to be anywhere in this application.

    It would be FMRS in this case.

    thanks, but actually I think we are going to apply for eea2, and eea1 jointly. I found out that she does not need to be registered under WRS because she is a Spanish National. She is exercising her Treaty Rights because she has a permanent contract with a company in London.

    Yes thats right. You mentioned WRS so I thought she was national of one of the A8 countries.
    EEA2 it is then.
