✎ EN Would I need a work permit and visa for this?

    My wife and I are planning on travelling long term abroad beginning in the Fall of 2004 or Spring of 2005. We would probably be staying several months at a time in different countries and would also be looking at moving to one of them on a permant basis. We are looking primarily at Europe and Australia.

    I know that visa regulations and other applicable laws differ, but am looking for general information on my situation and have had a lot of difficulty finding any.

    My wife works for a counselling and entertainment telephone service in the US, where we reside and are citizens. With the advent of VoIP it is practicle for her to continue with her independant contract work (ie she is self employed) anywhere abroad that we could have high-speed internet. I am beginning to work doing internet marketing and entertainment and again I could do this from anywhere in the world with good internet access. Neither of us recieve any income from a business in a nation we would be visiting.

    Would we (generally) need work permits and visas to continue this on our travels abroad? Could we just do this on tourist visas? Given our situation and the specific nature of our business I think obtaining a work permit and visa would be very difficult for us.

    In theory (I hope I'm not wrong, I'm not an expert ;-)), if you do not stay more than 3 months in a country you won't need more than a tourist visa. If you keep an address in the US and we can consider that the address of your company/your own address is in the US, I do not think that anybody will consider that you are actually working in another country... You are still based in the US and working remotly.

    In addition, if you stay less than 183 days in the same country, you wouldn't be considered as resident of this country. Therefore the local government tax won't be involved in your business.

    As a self employed person, you might have an accountant, or at list you can ask information to the local tax department to know exactly how it is going to work (you might need to come back to the US for some time, I don't know).

    Anyway, if you can tell us results of your quest, it would be hepful for others :)

    in order to keep this helpful forum accurate I must regrettably say that this idea theory is wrong. :geek:
    If someone is physically present in another country regardless of their company address being in the states because they are physically present in another country this is considered foreign earned income. there are two tests that the IRS use to establish
    if you qualify for the foreign earned income exclusion which is something i'm sure will be of interest to the readers of this thread. the Bona fide presence test and the physical presence test. for more information readers should go here: http://bit.ly/ExpatTaxReturn
