Hi, I wonder if you can help me. I am a UK citizen living in Colombia and want to take my Colombian husband to live in the UK. however, the only way we can do this (because i am a student and dont have the finances for a spouse visa) is to go to spain and exercise my treaty rights by working for 6 months and then apply for the EEA family permit to enter the Uk using the Surinder Singh loophole. My question is, how can we get to Spain, both travelling at the same time? Is there an equivalent of a EEA family permit for Spain? My understanding is a Schengen visa would expire after 90 days and my husband would have to leave. Also a "reunion familiar" visa would mean that I would have to go there first, and be earning a reasonable wage before i could apply for him to join me. It seems unfair that a spanish woman going to the UK could take her colombian husband immediately and start work. Can I not do the same for Spain? Thanks in advance
Yes you can. You can either go for the 'Family member of an EEA national' visa for him or get a Schengen visa and once in Spain, apply for the residence card for him. Good luck
