✎ EN Marry in UK

    Hi All,

    I am a Pakistani citizen and have been and working in the UK for the past 4 years now and am 28 years old. I am recently seeing a Polish girl who is 21 years old and has converted to Islam and we would like to marry each other but I guess we thought about it a bit as I only have 3 months of visa left.

    Can anyone please give me some advice on the questions below?

    1. As I only have 3 months of visa left, so I guess marrying in Poland is out of question as I read in some of the thread that that would at least take 6 months.

    2. Would it be possible for us to marry in the UK?
    a. If yes, then what should we do in that respect?
    b. Would I be able to live and work in the UK after that?
    c. Would I be able to apply for EEA family card?
    d. How long does the marriage process take in the UK (only official ceremony) as we intend to have our proper wedding ceremony in Pakistan and also with her family in Poland?
    e. How long will take take for me to get an EEA family card? and what is the process for that?

    I am sorry for the long list of questions, but I havent dealt with such issues before, so any help with the above questions will be much appreciated!!

    1 - Yes thats correct.
    2 - Yes
    a - Apply for certificate of approval i.e. permission from the UKBA that you want to marry.
    b - Yes, even though marriage doesn't automatically change your immigration status.
    c - There is no such thing as EEA Family card. Depending on what your spouse is doing in the UK, you can either go for FMRS ( one year ) or EEA residence card ( 5 years ).
    d - That would depend on how fast UKBA issues you certificate of approval and where do you intend to get married because the registrar office in your place might be busy.
    e - Read c above. FMRS can be quicker but EEA2 can take from six months upto 2 years.

    However, one thing I should have mentioned before is that my girl friend is still studying at uni but I am working here. Would that work for EEA2? and if the process takes 6month to 2 years then would I still be able to stay and work here unless the HO reaches a decision and issues me EEA2 residence card?

    Finally, would you suggest its better to marry in Pak and apply for EEA2 at the Polish Embassy in islamabad?

    Please if you could tell me whats the best way forward for us ? My visa Expires in Feb 2011.

    If she is studying, you can go straight to apply for EEA2 bypassing the FMRS requirement.

    However unless UKBA comes back to you with a decision, your status would remain the same as it is currently and this should be mentioned in the Certificate of Application that you would get from UKBA.

    In practice however, you would find it difficult to convince your employer to let you carry on working so that would depend on how strong you can argue.

    You can of course get married in Pakistan but you cannot apply for EEA2 from outside the UK. From Pakistan you would apply for EEA Family Permit ( at the British embassy ) which is issued for six months and once in the UK, you can then apply for EEA2 ( which in that case would be mere an extension ).

    Both options have their ups and downs so its upto you to decide. Even though getting married and applying from within the UK towards the expiry of your current visa can well be seen by UKBA as a last minute attempt to gain residence in the UK.
