    Hi all forum friends.
    My name is shahzad i am from pakistan.
    My wife is polish but settled in uk since 2003.first time we met on internet in 2009
    then on 18th september 2009 she lived with me for almost 2 weeks
    then she back to uk on 6th october 2009.
    After went back we contact each other with online chat and by telephone calls.
    We fall in love each other and she purposed me for marriage i accept this offer
    and she again came to pakistan to marriage with me on 4th february 2010.
    We got married on 10th february 2010.actually our wedding dates of ceremonies were 7 ,8 february 2010. But unfortunately my mother dead on 7th february 2010.
    So we simply got married on 10th february 2010.my wife went back to uk on 19th march 2010. So i applied for my settlement visa of uk as a husband of eea wife.on 20th april 2010.
    But my application was refused on 8th june 2010.
    I attached some sporting documents with my application.
    Photo copies of passport and id card of my wife.
    Her bank statement and pay slip.
    Her rented house agreement.
    Her job agreement.
    Sponsor declaration letter.
    My cell phone calls details of three months.
    Nikah nama (marriage certificate)but it was in urdu not in english translation.
    Wedding photos of both and some casual photos.
    When i got my passport and documents.
    I got a refusal paper of entry clearance.
    In which uk border agency officer wrote that
    the decision.
    You state you met your spouse in september 2009 in lahore and that your relationship began february 2010 but failed to provide any details regarding your relations such as hoe you met and despite your claim to have lived together for approximately 5 weeks you have not provided any satisfactory evidence of your subsisting relationship.you claim to have been in contact since you met however you have produced little/no evidence of contact between the two of you in the form of letters emails photos of cards for special occasions such as birthdays.i also note that you have failed to supply a translations of your nikah nama marriage certificate photos of your actual wedding ceremony.

    In view of the above i believe that this is a marriage of convenience and i therefor this application i therefor refuse you eea family permit application because i am not satisfied that you meet all of the requirements of the immigration (european economic area)regulation 2006.

    Now i have translate our nikah nama in english language also attested from ministry of foreign affairs of pakistan.
    I want to know that now what should i do
    i an not ready for appeal .
    Cause i can't wait so long.
    I wish to fresh apply for again settlement visa.
    Cause i have complete all my documents.
    I need help to write a covering letter
    that what should i write in it.
    And i want to know that can i again apply my visa application after refuse of an application within one month.
    Pleas request someone to help and guide me.
    Also my wife's bank statement and pay slips are old do i need fresh bank statement and pay slip ? Or old are enough.
    Pleas reply me as soon as possible
    i am waiting.

    I am not surprised you got refused. Why on Earth would you submit your marriage certificate in Urdu without its English translation ??

    Besides, you will have to work hard on providing evidence to support your story i.e. to prove you are telling the truth about your meeting with your wife, the time you spent together, the ways you were in touch in and most importantly, that you intend to live together permanently.

    As the ECO has pointed out for you in his refusal letter, you need to make that letter as your guide and provide whatever was missing in your earlier application. Also keep in mind that since you are apply from outside the EU, the normal UK immigration rules apply which in simple words means, you should be ready for a struggle.

    As for your fresh application question, as far as I know you can't re apply within six months of your refusal but not sure. You can contact World Bridge through e-mail which is free and confirm with them.

    I am not surprised your settlement application failed, because it has all the signs of a bogus marriage of convenience for economic advantage.It is up to you to convince the Entry Clearance Officer otherwise. Unless you can come up with something new, if you apply again, you will just get another refusal. The UK has every right to refuse entry to the non EU/EAA wife of an EU/EAA citizen on a number of grounds. The application forms and Gidance Notes are quite clear. It is you who has to make the application, and do the convincing, not your wife. She is merely providing evidence of financial support and accommodation, and even that needs to be sufficient, considering most, but not all Polish nationals in the UK are earning modest salaries in jobs that UK citizens are not willing to do.
    The ECO may be interested in such things as how much you and she have saved up since marriage, whether you and she have a joint bank account in the UK, and many times your wife has visited you in Pakistan since you were married.(If it is none, that would indicate either a lack of funds or a lack of real marriage. Either of those would be bad.) These are all normal things that married people do. Of course,you could always go to live with your wife in Poland as has beensuggested, but even that would not get you into the UK later if it was suspected you have previously tried to get in illegally. It seems few Poles have the intention of remaining permanently in the UK, and in fact, many are going home , now that the Polish economy and living standards are improving rapidly.
    Of course, if you and your wife are so much in love, and want to live together, why does she not just go to Pakistan, live with you there and you house and support her? That would be perfectly normal. Unless of course your motive for marriage IS just to get into the UK.
    These are things from my own experience, but I was successful first time and the permit was issued immediately.That is because I did my research first.

    8 years as a student in the UK? It only took me 6 years from when I started my BSc, until I had my PhD. What did you achieve? Or were you one of those professional students? I bet you were working illegally all the time you were in UK. Well, its all changed now, since the new government reviewed our immigration system.Tier 1 highly skilled is already cancelled, and other tiers to follow. No more workers wanted or needed from outside the EAA. Work permits will no longer lead to settlement either, and the post study visa system will be cancelled for new students too.
    In your posting you virtually admit you married because you were certain you could get back into the UK that way.You were wrong. Furthermore,you are wrong to assume that a aquisition of a Polish passport will automatically get you in either.If you have previously been refused entry because the UK believed you tried to back in illegally, ie. by fake marriage, the UK can still refuse you entry under UK law. In fact, with your apparent attitude to the UK, I fail to understand why you would even want to go there at all. Do you know that there are at least 250,000 Pakistanis on various internet sites trying to find UK wives, but there is no evidence of UK women looking for Pakistani husbands on internet sites. In the UK, arrests and deportation of those involved in sham marriage scams are a daily occurence and almost all involve Pakistani men. Small wonder that our overworked Embassy staff are suspicious of so many applicants. Our Pakistan Consulates have by far the largest number of bogus applicants in the world trying to get into the UK, followed hotly by Bangladesh....formerly East Pakistan....
    A final point.It is difficult to imagine any Polish lady who would be willing to give up her Roman Catholic religion and convert to Islam to marry a Pakistani. In fact it is even more difficult to imagine that she would ever ever consider marrying ANYONE who would not agree to all children of the marriage being brought up as Catholics.
    New genuine visa applicants are still welcomed in the UK, but the scammers are not wanted. I thought this forum was set up to help genuine applicants, not to aid in any way those out to get into other countries by deception.
