✎ EN Tourist VIsa and Marriage in Uk Or Eea Permit

    Hello,

    i am a french citizen currently linving in france and planning to move to uk soon.my fiance is a pakistani citizen living in pakistan.we are planning to marry and live together in uk.i would move to uk first and then my fiance would join me.i guess there are two ways: marrying in pakistan and asking for a eea permit, or asking for a tourist visa, then a coa, marrying in uk and switching my husband's tourist visa to a resident card.wich way would be easier and faster?
    I will myself search for a work in uk once settled there, but i'm afraid i won't be able to work full time straight away and won't fulfill the income requirements to get a eea permit.i also thought of studying in uk and getting a grant plus a part time work.which status would be better, worker or student?we're really lost and would need advices on what do in our own case.

    Also, my fiance is 19 and we've read somewhere that one should be 21 in order to ask for a eea permit.is it true?

    For getting married in UK, you both need to be over 21. If any of you is younger than that, you can't get married at all. However, if you are married outside UK in a place where age of 21 is not required for example Pakistan, you will get through i.e. a marriage valid where it took place is valid inside UK too. Hence, getting married in Pakistan and then applying for an EEA Family Permit is your best but not the only choice.

    I am not sure if there is any such age restriction on marriage in France as well but I would suggest you also give a thought to getting married in France. Remember that if you apply for EEA Family Permit outside EU, the normal UK immigration regulations apply which in simple language means, its a lot more difficult.

    My best advice would be to get married, get your spouse to France ( no matter what kind of visa - take whichever is the easiest ) and then apply for EEA Family Permit to move to UK together. In this case, your EEA FP application will be from within EU and pretty straight forward.

    You don't have to be working or settled in the UK, you both can go together from France or Pakistan ( even though from Pakistan as I said will be a lot harder ). As for working or studying, that wouldn't make any difference since in both the cases you would be exercising your treaty rights.

    Thank you very much for your reply.if we marry in pakistan and my husband comes to france with a tourist visa, and then we apply for the eea family permit from france, do we need to provide a french marriage certificate or the pakistani marriage certificate will do?

    I am pretty sure yes. You wouldn't need to register your marriage in France but I would suggest you get Pakistani marriage certificate along with few photo copies ( and all other documents of your spouse if you can ) attested from the Pakistani Foreign Office. They are based in Islamabad but do have local offices in provincial capitals who can do it for you.

    again thak you very much for your reply and links, it has really helped us.i have a new question though.we thought of only marrying religiously and getting a civil partnership in france.would my fiance have the same rights to get a eea family permit with a civil partnership or marriage is a must?
