    Hi! I'm about tho apply for permanent residence using the EE4 form. I am mexican and my husband is spanish and we have married for 5 years and living in London. I have been a full time student for the last 3 years and he has been claiming benefits for almost 2 years. Now he left the benefits and he's doing social care. Do you think Home Office will reject my application for this reason?

    I'm worried, please let me know is a similar situation..

    Hi! he has the job seeking allowance and house benefit but he stopped them now. He had worked the first 3 years and he's now doing social care work as a volunteer. I was working full time the first 3years and I am now a full time student doing a BA... what do you suggest me to do? should I send also my paperwork too like payslips or p60's?

    Thats what I wanted to know. Receipt of job seeking allowance also comes under 'exercise of treaty rights' so such benefits don't affect your application for PR.

    You are actually required to submit all the evidence of your working/school certificates etc but more important than that, is the evidence of your husband's exercise of his treaty rights for the last 5 years. Make sure you include his P60s, P45s, payslips, whatever you can get hold of which proves he was working for the first three years. For the remaining two years, he also need to provide documentary proof that he was on job seeking allowance.

    Remember there is no such thing as 'too much documents' regardless of how 'easy' it might look from the UKBA site so provide as much documents as you can with the bottom line being your husband was working for first 3 years and then recieving job seeker's allowance for the following two years. Don't worry about the fact that he has been recieving house benefits, that has nothing to do with your application.
