✎ EN Waiting for EEA2 - travel abroad (China)

    Hi,

    I am Chinese married to the EU (Polish) citizen and applied for the EEA2 resident card 6 months ago. I have to go back to China but a lady from the HO told me on the phone yesterday that they have about one year delay.

    I can not wait another 6 months and I asked to return my passport, as we have to go with my husband to China in May. I can go to China but how can I come back to UK? I have only expired visas in my passport and the EEA2 is still under consideration. Can someone give any advice, please?

    My husband will be with me but is it enough to show on the airport in China a letter from the HO , marriage certificate or a letter form my employer so they can let me in to the plane?

    According to EU law, UK immigration would have to let you in as long as you and your husband can prove that you are married. However, in my opinion it is unlikely that the airline will let you on board without a valid visa as they don't want to risk anything. If you have enough time in China, you could apply for another Family Permit there. This would then again give you 6 months of hassle-free travel in and out of the UK.

    Thanks for your reply.

    I will be 3 weeks in China with my husband. When I spoke today with someone from the HO, they told me that I have to apply for "Entry Clearance" in the UK embassy in China.

    Is 3 weeks enough to receive it?

    Sorry - I have no idea, but I'm sure others can tell you. They are supposed to issue these Family Permits without delay, but you never know what this translates into with British authorities. ;-)
