✎ EN EEA family permit AND disability

    Hi all
    Im new here. My names Gary and I have been registered disabled since 2002.
    My question(s) is Does anybody have experience of submitting an eea family permit application under incapacity rules?

    I reside in N. Ireland and given dual nationality Irish/British I have been informed that I may apply to have my spouse (filipino) join me under EU rules.
    Unfortunately 'recourse to public funds' very much applies to me yet because i worked in the UK before becoming incapacitated I may apply as someone that 'exercises free movement' or in other words I may be 'qualified' as a 'worker'.
    I have been informed that UK immigration do not like this approach and we may be turned down or they may try to apply UK rules.
    We've been together over 2 years, since jan 2005, physically together 10 months+ out of those 2 years. Married Jan 2007 in Cebu :D

    I have alredi applied. Today in fact with medical letter from doctor stating permanent incapacity... emails and telephone bills along with flight tickets receipts photos to evidence longevitiy... marriage certs, disability entitlements etc etc blah blah...

    Can they (the ECO's) really turn me down citing UK rules or do I have a genuine chance? Any input would be nice.

    I am 31 and my wife is 26 and we are expecting our first child first week November. Hence the urgency. I suppose I want someone to put my mind at rest and thats probably a bit difficult.

    I rent from the council with full HB. Although my wife is an experienced teacher in her own country and I fully expect her to continue her career here given training so obviously we will not be reliant on the system for too long << that's for those who may disapprove.

    Thank you very much Triple H. That has basically answered every question I have. I apologise for being over the top with that post.
    It is so frustrating because my wife is expecting and I feel like I'm failing them both. Thankfully now I have an immigration lawyer on my side and he reckons my case is very strong.

    Hi Belfast,

    I'm happy to say my wife and son are now here with me (she was pregnant when she was in Cebu back then, dont know if that was a factor) , they got here July 2007. My advice to you would be to get your doctor to write you a letter explaining your incapacity for work< it should be a permanent incapacity. You must apply under EEA rules...meaning you must use your Irish passport, if you have 1, if not get 1 because the British process is impossible assuming you are in the same situation as me.

    Secondly get your local MP to support your application after you have made the initial step of applying.

    However having said all this from my experience call this number betwen the hours of 9am and 12pm Mon-Fri 02890244401 < Law centre... ask for the immigration advisory line. Please do this because they know what you should do... explain your situation

    British way costs literally thousands and if you aren't working it will be impossible..

    Irish way cost me 700 pesos for the courier to pick up my wifes passport and take it to manila

    No other costs and she now has an eu residence document valid until 2013 and she can travel across borders freely... it really is a bonus being from Northern Irleand because of the Irish passport.
