    HI,

Iam an Indian married to a french citizen, living in UK for the last 18 months. We got married in India(may 2007).i came to UK immediately with him after the wedding on a 2 year visa & work permit issued by the company i work for.My visa expires in March2009.

I applied for the EEA2 permit in sept2008.But in Oct2008,had to travel to India due to unavoidable reasons. So i requested the home office to return the passports (husbands and mine). But they replied after a few days saying that they have misplaced the passports and that they were willing to bear the expenses.we re-applied for the passports and got the new ones in time. But when i requested them to re-stamp the work permit - 2 year visa that i hold, they asked me to withdraw my EEA2 application.Coz, 2 applications cant be processed at the same time.So i had to withdraw my EEA2 application.

i was back from India in 2 weeks time and requested the home office to return all the supporting documents that i had provided earlier.after waiting in vain for 2-3 weeks and repeated requests/calls made.i was advised by the duty officer to not wait any longer and re-apply for the EEA2 permit with a fresh application, but referring to the earlier recorded delivery number for the supporting documents in the covering letter.I did as advised(i also sent the photo copies of the new passports and mentioned explicitly that i would be sending the passports, once the processing has started and once they request for the same.)
My application reached the HO on 27th November2008. I havent received the certificate stating that my residence is valid and that iam eligible to work for any employer in UK.Its been 4 weeks now.Iam very worried and depressed.
i want to start looking for jobs and quit the present job coz my project gets over in march.
i called the HO and they have asked me to wait and they would get back to me about the certificate.
When i qouted that i need the certifcate urgently coz i need to search fr a job, they have qouted a telephone number and asked me to provide it to consultants, the employers can call the required number and ask the HO if iam eligible to work in UK.

Has anyone come across a similar situation were, they had to provide a telephone number to the employers to verify if their stay in UK was valid(in the absence of the certificate?).

Kindly help. Also please advise on what i can do in this situation.

You should receive a certificate of application, which is usually issued about a months or two after you applied. But the certificate has not significance in itself, it only tells the employer to phone up the UKBA to verify your status. So with the certificate you should be able to apply for a new job, although sometimes you have to convince the potential employer to actually call the UKBA.

The residence card application unfortunately take a long time. Currently it is around 8 months, which is bound to grow to nearly 9 during the holidays. Whether it will get faster next year is not clear. So it could be a while before you get your actual residence card. But if it has been more than 6 months since your original application, you should send a complaint letter, and ask for application to be treated urgently. You have to point out that it is the same application you originally submitted, so you have been waiting a long time now.
