    Hi all,

My wife is a non-EU citizen and I am an EEA citizen,
we currently live and work in the UK.

Now, I will definitely be staying in the UK, but my wife has been looking at applying for some jobs that would be extremely beneficial to her career in Germany. Can someone please tell me whether she has any statutory rights in terms of a work permit in Germany through being married to me? Do I also need to be a resident of Germany for her to enjoy these rights, or would she enjoy them regardless of where I am?

All answers would be much appreciated, and any case law/links supporting your information would be brilliant as well.

    Thank you in advance.

    Carl.

Yes, she only has the right to work where you are living. That is because only you have the right of free movement, whereas her right of residence is granted to facilitate your residence.

She may be able to apply for a work permit, but that depends a lot on the specific job.
