Shoptime Specific EEA family permit procedure query - please help

    Hi everybody,

    I've read the sticky regarding EEA family permits (which is incredibly helpful btw., seeing as the position is by no means clear on the government site), but still have a few questions regarding the procedure.

    My fiancée, a Polish national and myself, a South African citizen (i.e.non EEA) are getting married in August in the UK. We have both been living in England for a number of years. My fiancée registered as self-employed a few years ago and has been living and working here on that basis for 4 and a half years. I have a 5 year work permit and have been living and working in the UK for nearly 3 years. I understand that after the wedding I will be entitled to the right to reside and work in the UK by virtue of my fiancée’s EU treaty rights and that I can have confirmation of these rights in the form of a residence card printed in my passport.

    My questions are as follows:

    1) My fiancée, does not have a residence card yet (which, I believe is to be obtained by filling in and lodging form EEA1). Is my EEA2 application dependent on her having acquired this card? If so, would it be possible to submit our applications simultaneously? If we could submit simultaneously, which address are we to send the applications to? (I note two addresses in Croydon and Liverpool)

    2) I have read that the waiting period for EEA1 and EEA2 applications is round 7 months. Are we permitted to travel abroad within this time? We want to go on holiday shortly after submitting the application(s) and want to know whether there is a procedure whereby we could have our passports back before they are are decided.

    3) After we/I have received the stamp(s), is there anything else to do before I can stop relying on my work permit?

    Any advice would be greatly appreciated!

    1) She would need to apply for a residence certificate. This document seems to be utterly useless, however, as I found nobody so far who could tell me in which situtation it would be useful. The certificate is optional anyway as is the residence card. But for all practical purposes you will find the residence card a must to have.

    You may apply simultaneously (both to Liverpool) but unlike in the past that doesn't seem to speed up the process anymore. Again, no dependencies between EEA1 and EEA2 applications.

    2) Some people recommend not to send the passport with the application but rather wait until HO asks explicitly. Others also recommend to just send certified copies of the passport. You can ask, in principle, at any time for your passport to be send back to you but that may take some time (sometimes quite long and only after repeated requests).

    3) The residence card is not a stamp but a sticker. You should be all set when you receive your passport back.
