    I have been reading the all post on this forum so I have decided to ask some opinion. I entered in UK on visit visa on July 2004.i overstayed my visa then I met one girl who is French citizen I felt in love with her and we decided to live life together and we started to live together. Then we had applied for certificate of marriage approval which I can get married official home office took a lot time to reply for that .after a years and half later solicitor advice us to apply for eea2 family permit. We are living together as husband and wife since over 3 years. We had applied for eea2 family permit on 16 aug.2007 two days later I received letter from home office that they want to discus about my immigration status so I went to home office in Old Street. And they gave me answer of my certificate of marriage approval after 1 years 7 months .that they refuse my application. eea2 application take 6 months to answer .after applying the eea2 my solicitor receive the letter that they have receive application and its under consideration .6 months period finish on 16 feb.2008 .today 10 months finish still no answer I don’t know what to do .what we should we do if home office delay the 6 months rule and they have not reply anything. Our life got stuck. I am worried what will be the answer will they give me resident card or not, when they will give, when they will reply. I am worried, will anyone will help give us some advice .I will be thankful. Thanks

    I am so sorry to hear about your case mate but why you didn't try to get married away from the COA first and then you could apply? Which country are you from?

    Easy123, you are not alone in such situations. It is obvious that the HO is delaying your application because of your previous immigration status as an overstayer. Did you apply for an EEA Family permit or an EEA residence card? To the best of my knowledge you can only apply for the permit out-of-country (I may be wrong). Did you supply sufficient evidence to show that you and your partner have been in a durable relationship for 3 years? From what I understand getting EEA permits/residence cards could prove difficult for unmarried partners as the EU Regulation is not very clear on their rights as extended family members of EEA Nationals

    Some of us are working on a petition to the European Parliament highlighting the misapplication of the EU Regulations in the UK which has resulted to residence card applications exceeding the 6 month deadline, CoAs not being issued immediately and so on. Your experience only helps to buffer the points we have raised.

    thanks for your .

    i have applied for eea2 family permit. i have applied on 20 aug. within 2 days i have received on 22 from home office COA .while application underconsideration i can work. but then after i have not receive anything from them. its now 11 months going. what should i do.some advice plz.

    You should try contacting SOLVIT http://ec.europa.eu/solvit/site/index_en.htm to lodge a complaint and have them take up your case.

    as i have contacted my local mp about delay of application.home office reply to mp that as i did not have valid leave to remail when i maid my application we need more time.and EU law does not recognise the concet of common law relationship.i am bit worried .now what will be the answer will home office refuse .plz need some help
