Hello. I was wondering is there is anyone who could help?
I live in UK and have a problem with TV licensing
Me and my husband moved to stay with one lady who had a TV before
When we have moved in she did not have it. She rang TV licensing 2 cancel the prescription so they send their representative to check if there is a TV.
She was out a a time of a visit so I opened the door and answered the questions. Representative then asked me to sign the paper in which he was writing what I was saying. I said that we do not have a TV thou there is still a dish outside which we are not using as there is no TV. Later i have received a letter from them saying that i said that there is a TV so should pay. We ignored it as i never said there is a TV. Now i have received a summons to court for having TV without having a TV license.
Regrettably, at the time I did not read the paper nor it was read to me, and I signed. The assumption on my part was that he wrote my answers exactly how I had replied to his questions. Furthermore, a copy of this paper was not provided to me, to read in my own time. It was not until I received a summons letter , that a copy of this paper that I signed was included. At which point I saw that completely inaccurate information had been recorded. On the paper there are questions which have been completed which I was never asked and therefore could not have provided answers.
My husband was in at the time of a visit, there is this lady who lives here as well and i have a friend who have been over couple of times in this flat.Would it be enough to prove that we do not have a TV?
We rang to the TV licensing people and they said that they have a proof because i have signed the paper and that there is a receiving equipment( i guess a dish).
My only problem is that regrettably I did not read the paper while the Officer was with me.
I stress once again that I have never used a TV at this property. What can i do?

The receiving equipment is not a proof of TV at all (it could have been a dormer tenant who moved and it's difficult to go on the roof to remove it, not necessary and you might buy a TV later and need it).
In theory, a letter explaining the mistake attached with a testimony of the other occupants saying that there is no TV should be enough to make them stop.

I have sent a letter to the court explaining what happened but i did not include a testimony of people who live here. I wrote names of witnesses.
Would it be sufficient do you think? If i am called to the court these people are willing to attend to testify for me.
    Thank you .
