Hey Biggy thanks for the reply, how you doing?yeah i applied under a durable relationship and we've even got too kids and been together long enough, though we're not married.what's your experience or opinion on this if any?Its just a year this month i applied and still no responce except for when they asked me to send my partner's most recent pay slip about five months or six after i applied which i did immediately,i have'nt heard anything since.Anyway, its been very rough and tough for me ever since as you can imagin my situation of not even been able to secure a job with the certificate of application.

Hello peace101,i am ok thanks alot.
When did you apply for EEA2?
You made mention of your application still under consideration for more than a year now!!!wow that is strange. To the best of my knowledge, the HO has got a maximum period of 6 months from the time the application is submitted, to process all EEA Residence card applications.(EU Law)
Did the HO write or inform you why the decision on your application is taking so long to reach?
Did you write the HO a letter of notification of bridging the required 6 months period of processing your EEA2 Residence card?
I would advice you to look for an immigration Lawyer and seek some advice on what to do.
    Meanwhile keep hope alive.

    EEA2 application response

I placed my EEA2 application on 13th Nov and received and ack. It has been just about 6 mths now May 2008. Just 4 days ago since I moved to a new job as a IT contractor I was asked proof of my status whcih I provided in a Home Office letter which I showed the clients and there are 2 lines on the first page 5th paragraph staing that while the application is being processed the non-eea applicant may be employed or look for work. I didn't put an EEA1 I think as my wife is looking after my daughter so we are on 1 income. The potential employer accepted it without much delay to me starting employment. I then called the Home Office to check my status on the application as I stated the emplyer has some doubts and the reply was call the home office on the no quoted or write for clarification. Employer did neither and just 2 days later I got in the post that I need to send some proof of support of my wife and daughter. I called the home office to check what was needed. Payslips,Bank Statements for 6mths. I have since supplied this info 2 days ago via registered post. My concern now is my passport has expired now on the 5th of may 2008. I can't say wether they will approve my residence as I asked wether if I took the passport back and then sent it in again and they said the application would need to be resubmitted. So now I will have to wait and see hopefully soon receive it and approved??? and then apply for a new passport as my is now expired.. I don't know wether anyone else was in a similiar position....

    Application Date: October 31, 2007

Well, today I received our passports but without any visa! I really thought this was the end to all the waiting. We had sent in complaint letter regarding the inconvenience of having to recall our passports every time we need to travel, plus the fact that 6 months has past!

The letter just states to wait to return the passport until it has been requested by a caseworker!

Did anyone else go through the same thing?

In the early days I was told it would take UPTO a maximum of 6 months. I recalled my passport twice for travel. When it came up to 6 months all of a sudden the new excuse for the delay was because I recalled my passport. Hmmm, according to their website they are only now working on applications made prior to October 2007. Did ALL those people recall their passports too??

Had I known it would take SOOO long, I would have had my husband apply for the EEA1 and piggy-back my EEA2 application to his. People have had better luck that route. By the time I found out about this my application was nearing 4 months and I thought I'd receive the visa at any time. LOL. What a joke!!

EEA2 application comfirmation letter and request for passpor

    Hi there,

How long does it take for Home Office to issue an acknowledgement letter for receipt of my documents.
I sent my documents about threes weeks today and the home office has not written anything to me,WHAT SHOULD I DO?
My EEA permit runs out by end of May and i am to travel between mid June and July, What should i do if they dont respond to me before then and if i have to travel urgently, will they give me a short entry clearance since the other one got expired with them?
My wife is German and i am a non EEA member with a German residence permit,we did not know that it was advantageous to aply for EEA1for her but our marriage certificate and her passport is in my application pack at Croydon.
We have been to together for 6yrs and married for a little more than 3yrs, we have been visiting the UK many times from Germany and at the beginining of this year we moved in and wanted to stay and look for work, so had to change my EEA permit into residency card (EEA2).

Please can someone analyse my case and propose some possible scenarios and if i have to tarvel urgently between mid June and July, what should i do?.

    Thnx

I don't remember when I recieved an acknowledgement letter. I think it did take some time.

However, if you want to travel soon you should call up the office and request your passports for travel. I was told that if I leave the UK and my entry clearance expires that I needed to get a new entry clearance visa before coming back in.

I never did this! When I came back into the UK I told them that my application is still being processed. They just stamped my passport and let me in without a problem.

Call: 0870 606 7766 and give them the reference number you have (usually the special delivery number or recorded delivery number from the royal mail). Explain your situation and see what your options are.

After waiting over 6 months, I wish I recalled my application and got my husband to apply for the EEA1 and put my EEA2 application with his. I'm not sure whether anything has changed within the past 6 months, but according to some others on this forum this worked for them.

Do you have that in writing? If so, a copy of the letter would be nice to have :). It is certainly one of the more stupid arguments I have heard from the Home Office so far. After all, they could certainly work on the application with a copy of the passport. (And honestly, it does not take 6 months to decide a simple EEA2 application. Other countries do that on the spot or within a few working days.)

I am not sure that still works since the processing moved to Liverpool. To be honest, I cannot recall any posting mentioning a completed application since then.

As far as I know joint applications may also be send to Liverpool.

We sent our EEA1/EEA2 applications around Jan 15, 2008 to Croydon. I (EEA1) received my residence certifcate April 18 (certificate was issued on March 30). Unfortunately, we are still waiting for the residence card. Last time we heard from them was in early April requesting some documents to be sent to Liverpool.

    FINALLY!!!

I just received my residence document!!! The issue date is May 7, 2008. So it took almost 7 months of waiting.

The endorsement is on a flimsy sheet of plain paper which I find strange. I thought it was to be placed in my passport. Well.. I don't care. I'm just glad the waiting is over.

    :D

    Re: FINALLY!!!

Did you received it together with the passport? I ask because earlier you reported that you had asked HO to send your passport back.

    EDIT:
There may be problems if the residence card is not attached to the passport, see this forum[/url]

No, the residence document is NOT attached to the passport. They had sent me back my passport earlier. I really didn't think it would be a separate document but it is. I'll read the link you provided about problems that might occur.

Hey Calgary72, when exactly did you apply for your EEA2? Did the HO ask for extra documentation to suport your application? If so what documents did you send to them?

I am still waiting for my residence card. I applied on the 30th of Jan. '08 and am hoping that in a month or two we get some news...

    Hi guys!

I have just got my Residence Card after 6 months and 15 days of waiting!!!

I've read here that most of you are just waiting without trying to complaint. I definitely think it's worth complaining and showing them we won't stand for violation of our rights - I have complained and I've got my Residence Card in the result!

In short, I complained to Liverpool one week before 6 month deadline (which was due on 20th May) as my case was still waiting for consideration. As a result, my case was allocated and taken into consideration next day (!), decided on the 28th May and sent to Croydon to sort out the paperwork on the 29th May. After that I tried to call Croydon Complaints to find out what's happening as the guy in Liverpool could not deal with my case anymore since the papers were sent to Croydon. I could not get through to them on Mon and Tue. So I sent my husband to Croydon today with an authorisation letter from me to try to find out what's happening, etc, as much info as possible and also to try to speed them up a bit. And he's got it! At first they did not even want to let him into the building to make a complaint - said he had to call enquiry line to check the progress, blah-blah. But he made it! I have not seen him yet so I don't know what he did but he has just called and he's got all the documents - they gave them to him including the passport with the 5-year Residence Card!

So i do definitely think it's worth complaining and trying to bother them - if I had just waited probably my case would still be pending consideration!
