    hi all,

    I applied for a residence card on 13 october 2007, as you see, from the date of application was made six months passed.I still do not have my documents.On monday I wrote a complaint letter to home office,I hope i will get an answer from them.What I should do more?any suggest highly apprecieted.

    Send them a reminder letter, give them 7 days to produce the document.

    As to what you do then, that is a difficult question. You could sue the Home Office, I guess, but is that worth the hassle? You can also get your MP to write a letter, you can launch a complaint with the European Commission, or you could write to the Prime Minister. But I am not sure that the Home Office is impressed by any of this.

    We are exactly in the same case :)I have applied for a residency card on October 2007 ( I received the letter of the confirmation that my application is under consideration on the 18th of Octber) so there is exactly 5 days difference between us :) it is really a difficuly period form me :( it is not easy to be patient in this case but I think it is the only solution we I have decided not to call or to write to the HO (I am sure that it will not make any differance) , I saw earlier something on line which gave me some hope: they are currently working in october 2007 's applications which is logik (6 months and even more) so hopefully will get a response soon:) this is the sentence that every body is saying to me!!!
    So let's be patient together and hopefully will have a good news soon :p !!

    I have sent a complaint letter to home office 10 days ago ,I did not recieved response so far.You are right ,phoning to home office,writing will not change their speed i think.

    Have you received anything?? No thing for me :( I am still waiting !!
    I can't plan holidys, I can't go away :( it is annoying but I do not have choice!!!!

    Unfortunately, I have not recived my documents back although I wrote a complaint letter to home office.

    Nothing i do noe except waiting.i also can not make any holiday plan.

    Yeah it is not an easy periode for me :( the thing is that I got my passport ( I asked for it few weeks after my application, I needed it for 2 importants travles) and I got a letter from the HO asking me to keep the passport until required , but my eea family permit has experied so I can't travel :rolleyes: and you is your eea permit still valid? where are you from originaly? I am Algerian!!!

    residency card delay

    Hey people,we all in the same situation :( :( .i applied since may 2007 and received a certificate of application afterwards which still has'nt served its perpose ever since cos i could'nt get a job with it up till this day.I think the bst advice is to keep waiting cos calling them has'nt yielded any result and i'm just keeping my fingers crossed.Words are not enough to describe my situation and frustration.

    Hi ,

    My eea family permit expired in november 2007.I think we will wait longer than we expect.The decision process is si slow.Its just very annoying.

    I stop phoning up to home office as the same answer: your application is awating for consideration,it may take 6 months then i said it has already more than 6 months.anyway,keep hoping.

    I have received a letter from the HO requiring for my passport and few other documents ( some of them are a bit complicated to provide) but any way for me the waiting time is over Well it is not completly over as I do not have the stamp of the residency card on my passport :x but I have to say that they have(almost) respected the deadline :twisted: ) and I am happy with that, I need to provide the documents that they have asked me and will send them every thing hopefully by the end of the next week!!Does any one know how long it can take for them to resend me my passport after they receive the documents required?anyway will let you know!!!
    So an advice for all those whom are waitnig: BE PATIANT I know it is noyt easy but it is the only thing that works, do not chase them it is useless, people there are not doing an easy job so they diserve the time they required.....

    I admire your positive attitude, but a little bit on the wrong side of the law is still wrong. The 6 months are an absolute maximum, so regular cases should be treated a lot quicker, to leave some slack for the complicated ones. But as you can see, there is no slack at all.

    It was pretty quick for us, the mail time plus a day or two.

    I agree that chasing them is difficult. But I would still recommend to do it, you just have to be smart about where to complain. SOLVIT is good, because they are actually helpful. The European commission is good, because they have the power to force change. Your MP is good, because he/she is responsible for this mess in the first place. Complaining to the Home Office is next to useless, but you could at least be counted in some kind of statistics.

    I want to complete an online complaint form in SOLVIT.I am confused a bit.How i can complete this form,because country of origin only for EU nations?

    Here is what I have found out regarding 6 months deadline.

    Council Directive 2003/109/EC (http://europa.eu.int/eur-lex/lex/Notice ... isu=#texte) aims at creating a single status for long-term resident non-EU member country nationals and ensuring equal treatment throughout the Union whatever the Member State of residence.

    Article 7.2 does indeed specify that "The competent national authorities shall give the applicant written notification of the decision as soon as possible and in any event no later than six months from the date on which the application was lodged. Any such decision shall be notified to the third-country national concerned in accordance with the notification procedures under the relevant legislation ...".

    However, point 25 of the preamble states that "In accordance with Articles 1 and 2 of the Protocol on the position of the United Kingdom and Ireland, annexed to the Treaty on European Union and to the Treaty establishing the European Community, and without prejudice to Article 4 of the said Protocol, these Member States are not participating in the adoption of this Directive and are not bound by or subject to its application" .

    In other words, the United Kingdom is not bound by the provisions of the Directive.

    They can take as long as they want to :(

    I would chose the nationality of your EEA partner. And if that does not work, have your EEA partner sign the complaint.

    Well, this is the "Schengen" directive, and it does indeed not apply to the UK. You should look at Directive 2004/38, which has been ratified by the UK. It mentions the same time frame, and it is legally binding. You can also check the Immigration Regulations (EEA) 2006 http://www.opsi.gov.uk/si/si2006/20061003.htm , which are UK law, and again specify a response within 6 months.

    Many Thanks for your text.It is so claer that home office is required to make a decision regarding application is made.unfortunately,this law does not apply in practicaly.I put my complaint on Solvit,I will see what will happen.

    When I applied For FMRS last year,i received my documents back in 38 days.I made an application for residence card,six months passed,still nothing.I am so wondering why they are keeping my documents.I sent them exactly the same documents when i applied for for FMRS except 12 months continues employment in the uk for my eu nation spouse.

    I found better job,but i could not take it.I am loosing a lot of money.I am going to sue home office.

    In the majority of the EEA2 applications made under Durable Relationship seem to take much more longer to process,as to that of married couples.
    Lots of documentation is need for a Durable Relationship with atleast 2years of couples living together.
