    Hello, all

    Nice to meet you. I have questions about EEA2 application.

    I am French. I and my Chinese fianceé registered the Civil Partnership in France one year's ago. Then she came to UK as a work permit holder. I joined her 6 months ago.

    As a work permit holder, she can't take any work offers from other companies. Her work permit visa still has 4 years left.

    We are thinking about applying a resident card for her and EEA2 seems to be the only way. But we have several doubts about the application. The phone of immigration office has just never been answered.

    Can someone here help us to answer following questions?

    Can she switch from work permit holder visa to EEA family member visa, though her work permit visa is still valid for the following 3 years?

    French civil partnership (PACS) can be accepted by UK immigration authority?

    How long normally does it take to have the family member visa?

    Yes, you can switch without any problem. The Home Office may take the stance that the work permit becomes invalid when you apply, but she only gets the right of work once the application is processed. This is a pretty far fetched interpretation, but it could cause you some difficulties.

    I think they are only recognised for same sex couples, so most likely she has to qualify as an unmarried partner.

    The maximum duration is 6 months, and it is quite possible that it will take that long. As a spouse, she would already have the right to work during this time, but as an unmarried partner the Home Office maintains the position that right is only granted at the end of the process.

    So if she wants to change employers, she will probably have to wait until the application is decided.

    thanks for the answer. it seems that we misunderstood the civil partnership. Unmarried partner should be a tricky choice.
