✎ EN Overstayed visa - pakistani fiance

    Hello,

    I have known my fiance for almost five years and were engaged last month.

    Since I have known him he has been honest with me about his situation: he has overstayed his visa by almost 4 years.

    We are now at a stage where we're looking to get married and have a hundred and one un-answered questions.

    Here are a few:

    *1* How does he return to his country?
    *2* How do I apply for him to come back into the UK?
    *3* Would I apply using a fiance visa application?
    *4* Will it be difficult for him to leave the UK?

    I would be extremely grateful if anyone can point me in the right direction as to what step to take first.

    Unfortunately, it seems you have picked a bad time. See this blog for the new rules being introduced. You could try to apply for a visa before they come into effect on March 1st, but there is also rumour that these rules have already been applied on an informal basis for some time.

    I think your best shot is to move to another European country, where the visa situation is easier. You are then covered by the European right of free movement, and you would even be able to move back to the UK after a while. It is either that or spending a year apart/outside of the UK
