✎ EN UK Citizen married to USA Citizen living in the UK

    Hi

    UK Citizen married to USA Citizen living in the UK on a indefinite leave to remain
    We where married in the UK on a fiancee visa
    Also we have a child with dual Citizenship born in the UK

    We are looking to move back to the USA
    Does anybody have any info on the best visa to get

    Since you are a UK citizen, you can go to the US for 90 days without a visa. Go to the USA with your wife and child, and once there, your wife should start the paperwork for your spouse visa. Usually takes about a few months to process, but eventually you'll get your citizenship there due to your marriage to your American spouse.

    Not necessarily, as there are many circumstances that can be taken into consideration. It will be better for you to apply for it in the USA, as you will deal with less red tape, if any.

    Similar problem

    I was born in the USA in 1956 but moved to the UK in 1958. I have been married to a Bristish woman for 25 years (married in the UK). I have a valid US passport. We intend to move to the US on a permenent basis. We have completed the requested processes. I-130 petition medical etc. We visited the US embassy in London, for the arranged interview a few days ago to be told all was in order except for a sponsor for my wife.

    Is it possible for us to move to the US and apply for a Green card for my at some stage? Can she stay longer than 90 days, or until all the required processes have been completed?

    Try searching "direct Consular Filing" on google or the like.

    This is by far the quickest way to get from UK to USA. So long as your spouse meets certain conditions, its approximately 3-4 months of paperwork shuffling (sending/receiving), then a day trip to the nearest consulate, London, more than likely. There, the UK Citizen will be required to have a medical done, and you will go through a similar interview to the one the USA citizen had to go through.

    If you want to go the K-3 way (I think its K-3, at least) for a spouse, this will mean the USA citizen going to the USA to set up house, they will have to apply to their nearest consulate in the USA. This takes much longer, up to 18 months in some/most cases that I've read about. You cannot bring your UK partner with you though.

    Good luck though! My Hubby and I want to move back to the USA...When we got married, the UK seemed the best option, but the quality of life here is just crappy! lol.
