    My wife is Italian(its been 6 years she is here), We got married in May 2007. Right now i've applied for my Student visa Extension(as i am living in this country on Student visa that i got 3 years before from pakistan.

    I wanted to ask would i be considered home Student like my wife.
    and what about Full time Job,am i entitled to do that.?

    right now my passport is with Home office for Student Visa Extension.

    But we got married in May 2007.

    Answer to your second question is definitely No. If you are on a student visa, you are allowed to work only 20 hours per week and just because your wife is an EU citizen, doesn't change anything. If you wish to work full time, you should apply for a EEA family member visa instead of a student one.

    I am not very sure about your treatment as a home student but I think you don't have any chance for using this facility because your passport and student visa on it says that you are an international student. In other words, your marriage has not changed your immigration status. This is only my guess but you can easily find it out by writing to or visiting a university's admissions department.

    I'm not sure this is correct. As a spouse of an EEA citizen (who is a qualified person, for example by being employed in the UK) you are automatically allowed to work in the UK. One exception to this is of course if your relationship were to be interpreted as a marriage of convenience.
    I think it's worth reading up on this a bit more.

    You do make sense but what you are saying is only a theory. In practice, this is impossible. Not just this, there are many other things, for example the free movement of non-EEA family members of EEA nationals. The EU law says its allowed and no visa required but its impossible when it comes to practice.

    There are areas of non-compliance, but this is a clear cut case, and I see no reason why the EU law should not be applicable. The relevant application form is EEA2, and all you need is a bit of patience. Note that you cannot switch back to the UK law once you have applied under EU law or used the rights granted by the EU law.

    What makes you think this is the case? I really think you are being *far* to negative here. The procedures in the UK are certainly not ideal, but the EU Directive 2004/38 is on the whole correctly implemented. For visa nationals, free movement isn't entirely "free" in the sense that a non-EU spouse still needs a visa - but it is free in the sense that you don't have to pay for it (and the application procedure is supposed to be quick and painless).
