    Hi everyone,

Great website for information. was directed here by my friend.

    My case:

My girlfriend is eu(swedish) am non eu(ghana)
we are looking to get married in dec 2007.
am currently holding a student visa--runs out march 2008.

My 1st question is--after my coa is approved and marriage registered, do i go for eea1 or eea2.
am not too sure of the difference. do we fill one each or is it just me?

    also do i get 5yrs straight or 2yrs 1st.?

now my other worry is we have been together for 1yr (living) and we have
small fights every now and then which is normal when u live with a girlfriend.

but my fear is incase we have that big fight after we get married and we choose not to be together, do i loose my stay even if i have leave to remain left on my passport?

Also if we ever divorce and i meet someone whos is british can i marry that person if i still have leave to remain?

the reason why am thinking about all this now is because am still studying
and i can renew my visa if it runs out (i dont want to be stranded or be in mess).

we are only getting married because we care about each other.

Ps: what is the current fee for coa
what is the current fee for eaa2 or eea1...

Any response will be much appreaciated.
    Thanks

You have to be married first, and then you fill out the EEA2 form. Your spouse can also apply for a card using form EEA1, which is recommended, but not necessary.

    Usually 5 years.

Maybe I am old fashioned, but I don't think you should start your marriage worrying about what would happen in case of a divorce. If you don't intend to spend the rest of your life together, then don't get married!

Anyway, the legal situation is that you retain your right of residence if you have lived together for 3 years. Your residence card automatically becomes invalid otherwise, or if your partner moves out of the UK. And once you are on a European visa, you cannot switch back to a student visa without leaving the UK.

I think it was 175 GBP for CoA, and the EEA1/2 is free. Check the page of the Home Office, it gives a pretty good overview.

i didnt mean to sound negetive about the marriage, its just something i feel
    one should consider 1st.

do you know of any recent case of someone married to eu patner for 3yrs out of 5yrs and was still issued full stay or ILR?

If you are thinking that you will marry her ( after paying her or seducing her into your love trap ), get the five years visa and then say 'good bye, don't need you anymore' then its foolish.

I know of at least two such cases where the couple had lived more than four years and one such case where even the application for ILR was made, the visa was cancelled and the prince was detained, packed and sent home.

Very recently in Manchester, the woman proved that she was made to sign the papers as per force even AFTER THE ILR WAS ISSUED to the thug, ( who disappeared as soon as he got his passport with ILR back ),
and the police found him out, took his passport back and he is at the moment enjoying himself in Ardwick ( Manchester ) detention centre.

So whatever plans you have, there is no easy way !!
