    hi

    i need some advice about my situation which is im non eea national and i was married with eea national and ive got 5 years residence card,but things are going so bad between me and him and meanwhile im asking to divorce with him but it might take sometime,my step father and my mother are living here in the uk and my step father he is eea national and he is working here and he got certificate from the homeoffice for 5 years and my mum as well,im 20 years old and i really dont want to be dependant on my husband anymore so i was wondering since i read step children of eea national who are under 21 can apply for eea2 residence card without the need to be dependant.so can i apply for eea2 according to the rights of my step dad especailly now im living with him and would they give me like my step dad 5 years residence??thnx for ur help i would be looking forward for ur reply bye

    I am sorry for your situation.
    You might not need to do anything at all and might be able to retain your existing right of residence ( i.e residence card ). As you have not given full information of your situation so I can't suggest anything but you also need to mention

    how long have you been married ?
    how long have you lived in the UK for ?
    do you have any children ?
    what exactly is the problem between you and your husband ?
    is there anything like domestic voilence ? harassment of any kind ?

    depending on what answers do you give to these questions, you might be able to retain your right of residence.

    thnx so much for ur reply well im quiet sure that i do need to apply cos i dont have children plus im just living here for 2 years and it was not because of domestic violence so i dont retain the right to remain so thats why im applying according to my step dad who is eea national himself.but my question was since im under 21 do they give me 5 years residence card?cos dependancy is not a condition will they after i turn 21 ask me to be dependant especaily that im divorced can i proof financail dependancy only??thnx sooo much for ur help

    Definitely Yes !
    If you are dependent on your EEA national father who is working or self employed and is able to accomodate and maintain you, you will get the 5 years residence card.
    Your previous immigration history i.e marriage and divorce has nothing to do here. Also your being financially dependent on your father makes your age irrelevant.
