✎ EN I want to marry my pakistani boyfriend who is based abroad

    hi - i need some advise - im keen to marry my pakistani boyfriend, ive only known him for a year now - ive considered living in karachi but i really dont like it there and want him to move here to the uk,
    1 how do i go about this since i have not lived with him - in a cohabiting sence..i understand one needs to be together for 2 yrs....also i fear there might be some issues since he was living in the us and canada for the last 18yrs - he went there to study and was working there but did not have perm residency - they have some form which they submit inorder to be able to work there -- anyway, a year back he failed to submit this form that permits him to work and this became a court case following which he was sent back to pakistani and advised he could return after 2yrs... i know the us authorities are very strict.

    Id like to know if i marry - how would this impact on him being able to enter the uk and must i marry in pakistan - can i alternativley marry in say Dubai or India?

    Im concerned i may get stuck -i dont want to get married and then find myself here in the uk whilst he is still in pakistan ----not being able to move here to live with me....... im not sure what is the best way forward. i have my own flat and job here in the uk and he is setting up a business in pakistan.....Please advise, many thanks

    Thanx for your questions.
    You can marry anywhere you want and then produce the marriage certificate ( alongwith English translation if its in some other language ) at the British embassy at the time of application for visa. Besides, you don't have to be living together for two years ( thats the requirement only for same sex marriages ). You can apply at the embasy as soon as you are married. His past immigration record, in theory, doesn't matter even though the Entry Clearence Officer might be skeptical about it but based on what I know, it shouldn't be a problem if you prepare a strong case. As you said you have your own flat and job which means it will be easy for you to prove that you have place and enough money to accomodate and maintain your boy-friend/husband. Besides, you just have to prove that your relationship is a genuine one. You could submit for example photos of your meetings, any visas that you took to go to Pakistan to meet him and such other things to let the ECO know that you have been having this relationship for so much time and it didn't just start out of nowhere.

    i have another question for you... i got chatting to some immigration representative in the uk and he told me i must marry in pakistan since neither my boyfriend or i have ties with dubai - (personally i think the guy didnt know much) anyways - i hear there is a fiance visa -too
    id like to know if i was to apply for a fiance visa would it complicate matters if i then applied for a spouce visa at a later stage..

    if i applied for a fiance visa - so that my boyfriend could visit me in the uk - what do i need to show the authorities and how much time is he allowed for stay?

    also i hear to get ones spouce neutralised - foreigners have to live in the uk for 2 ys and are not permitted to leave the country for more than 90 days...as mentioned my boyfriend is setting up a company - in media production- which required him to travel ...also his curent base is karachi pakistan although he is also looking to set it up in canada too (where he was living and working until a year ago...

    how will he be able to work if he is not allowed to travel for his work/business??
    can you suggest what is the best action....

    About your chat with the immigration advisor, I have never come accross any such requirements as 'ties to the country' you want to get married in.
    The advisor was probably talking about the residence requirements in some countries to get married. The UK legislation actually says that any marriage is valid if its valid under the law of the country where it took place so I don't see any problem with that.

    I would however suggest you find out the
    pre-requisites/requirements that you must meet before you could get married in a country other than UK or Pakistan. You could find this information from the embassy of the country you choose.

    About fiance visa...It is actually to facilitate couples to come close to each other and then get married so its not going, in any way, to complicate matters for you. Fiance visa is issued for six months and it allows your boy-friend/fiance to come to UK where you could get married and then switch Fiance visa to a Spouse visa from within the UK.

    As to get naturalised ( not neutralised ! ) he will have to live in UK for three years with only limited breaks, but there is nothing like 'not allowed to travel/business' as you said. He will just not be able to apply for a Permanent Residence in UK and consequently UK nationality which means that he will have to keep renewing his Spouse visa.

    thankyou very much for your reply - i have another question for you - lets say if my boyfriend applied for a tourist visa and then got rejected
    and then lets say i later on applied for a fiance visa - does a tourist visa rejection impact on the fiance visa application?

    also im assuming i need to provide proof about my relationship again??
    would that be photos and visa stamps - is there anything else i may get asked to provide??

    thanx for your questions.
    You don't need to provide a lot of details about your relationship with
    your boyfriend in case he applies for a trourist visa because its meant for tourism only. Please remember that he can't get married or switch his tourist visa while being in UK.

    Past immigration record, in theory, doesn't have any effect on fresh application but as I said in my earlier post, the ECO might get skeptical.
    As a proof of genuine relationship, there is no hard and fast rule but normally pictures from past, visa stamps that you ( or him ) got to meet each other, print outs of any e-mails that you have been sending each other in the past, records/reciepts of any hotel reservation where you both might have stayed together, post office reciepts of any gifts, letters, cards that you have been sending each other and such cards and letters themselves if you have any, and if you have happened to live in the past, any proof of that like utility bills for example.

    Here you should remember that proofs like this depend on the individual cases so I would suggest, you provide as much details as you can. Don't think how ridiculous they might sound to you. Just think about the things that prove/can assist in proving your relationship and produce it, no matter what it is. The more information you provide, the stronger your case.
