✎ EN 3rd world citizen moving to the UK with EEA Family Nationals

    Hello!
    I have a few questions.
    I am not an EEA national.
    My wife and our 2 children are EEA nationals from one of the A8 countries.

    We live in my wife country where I work with a permanent resident permit.
    I currently hold a valid “C-Visit” visa on which it's clearly written “NO WORK OR RECOURSE TO PUBLIC FUNDS”.

    My wife is currently not working because we have young children.


    In case I manage to get an employment offer in the UK:

    1-) would it be possible for me to apply for the EEA Family Permit (EEAFP) strait from the A8 country where we live? Or should I just go to the UK with my C-Visit visa and apply for Residency permit there (EEC1/EEC3)?

    2-) Would the employment offer letter be a plus for my EEAFP or would it cause troubles to my potential/future employer and screw up my application?
    (I have heard bad stories about EEAFP being refused to people from “the 3rd world” who show their intention to settle in the UK.)

    3-) I need to get to the UK first and find a house for the family. with the family permit and the C-Visit visa, is it possible for me to travel alone without my family members?

    4-) Once I get to the UK without my EEA family. Would it be possible for me to LEGALLY work for, let's say 1 month before I go back for my wife and children?

    5-) What is the minimum salary/income I need to have if my wife does not want to work at the beginning, but she would like to study English and take care of our 2 children?

    6-) My passport will expire in about 6 months. I thought I could get the EEA family permit, start working in the UK and together with my family, apply for the EEC1/3 before I renew the passport. Would the short validity of my passport affect my application EEAFP and EEC1/3?

    thanx for your questions. First thing I would like to bring to your attention is the title of your topic which should have been third COUNTRY citizen and not third WORLD citizen as it sounds misleading and a bit hilarious too !

    As for your questions :

    1-) You can definitely apply from the A8 country where you live and it will be a lot easier for you than to apply in your home country. However you cannot apply for residence permit while being in UK on C-visa because visit visa cannot be switched anymore to another type of visa while being in the UK.

    2-) I don't know exactly what will be the impact of your employment offer on your application but if I were you, I wouldn't do it because the basic logic of EEAFP is that your spouse is going to work/study/be self-sufficient in the UK and you are dependent on her. The stories you have heard sound true to me. I don't think this matter has anything to do with your future employer but it might prove problematic for your application. It would be better if your wife could get such an offer. That will certainly help your application. By the way, if you have an employment offer, why not go for the usual employment visa ?

    3-) I really have no idea about this because travelling alone on EEAFP which you get for travelling with your wife is obviously risky but as you have C-visa too, so I guess it shouldn't be a problem but you should still find out more about it and also wait for more replies here on this forum.

    4-) You are definitely allowed to work while being on EEAFP in UK.

    5-) That depends on where you live in UK and what lifestyle do you follow.

    6-) Six months in your passprt is, based on what I know, not sufficient time for all your plannings. It might be enough to get an EEAFP but there is more than 50 percent chance its not enough time for EEC1/3 because the average time for those applications to get processed is six months !

    I hope this information helps. Don't forget to seek information from other sources because here on this forum, people would tell you only what they know which might not be conclusive.

    I think this is a bit more complicated. The EEA FP is issued for you to join or accompany your spouse in/to the UK. In the application process, you may have to show that your spouse intends to travel to the UK. I doubt that they actually check where your spouse is when you enter the UK, but it might still raise suspicion.

    Since you said it would be only for a month, this seems like a trivial amount of time to argue over. I would recommend that you come to the UK together with your wife, open a joint bank account and put her on the electoral register. Then she can go back on a "visit" (no longer than 3 months), and rejoin you later.
