My Boy friend is Irish; I am Chinese with student visa which will be expired 30th Sep. As I will graduate this novemeber, I will get my visa extended till December. We plan to marry at the end of October.
    My questions are:

1 I have been here with my student visa for 2 years. Can I transfer my student visa to Spouse visa without leaving the country? How long will it take? Where I should apply?
I assume the process should be simple as my BF ( future husband) is Irish

Once I have the marriage certificate, bring all the documents to GNIB to get Stamp 4

    Document needed:

    *Passport
    * Please include a photocopy of the passport biopage, all visas and all stamps
    * 3 colour passport photos taken in the past six months
    * Passport of Irish spouse
    * Photocopy of marriage certificate with notorised English translation (where appropriate)
    * An account as to how the Irish citizen met the applicant and a brief relationship history
    * Evidence that the Irish citizen has sufficient funds to maintain his / her spouse
    * Letter from Irish citizens current employer
    * Details of the Irish citizens accommodation in the State
    * Details of non EEA nationals immigration status in other EEA country if exercising EU Treaty rights
    * Notarised certificate confirming no criminal record

Althought I have done some research, but after reading so many difficulties of all the cases. I wonder if I can transfer Stamp 2 to Stamp 4 in GNIB and then with my GNIB card,I can go to re-entry office to apply for re-entry visa and they should grant me a EU spouse visa. shouldn't they?

Can anyone helps me on this? Please? THANK YOU

    Gemini

He is Irish and you live in Ireland so this does not apply to you.
Its Irish spouse visa that you need.

Thank you! But with Irish spouse visa, will I be able to travel EU Schengen zone & UK? or I need to apply for Schengen visa if I want to travel EU Schengen zone?

Just one more thing like to check. so is my assumption correct?
After regristering marriage,I just need to bring all the document to GNIB to re-issue my GNIB card ( transfer stamp 2 to stamp 4)?

    THANKS AGIAN!!!!

If things were all that easy.
You`d have to apply for a spouse visa and that can be long process.
I really dont know about switching from student to spouse visa.Irish immigration is kind of "closed shop" not much info can be found.
