Shoptime Residence stamp until 2012 but passport expiring next year

    hi guys, i wonder if you could guide me... i am a NON-EEA national , got residence permit for 5 yrs starting may 2007 and valid until 2012. my indian passport is expiring next year in march . i am going to change the indian passport in london but

    a) whats the procedure of transferring residence permit on new passport ??

    b) how long does it takes ??

    c) what application form needs to be filled and where to send ??

    i hope you guys will guide me through as you have done in the past... thanx in advance !!

    Sorry - but I think you'll have to re-apply. Here's a quote from the IND website:

    I'm sure you're thrilled at the prospect - and of course the Home Office will be very happy to look after your new passport for 6 months (or longer). From everything I have seen so far, I would be surprised if they had an accelerated procedure for this scenario - but I'm happy to be proven wrong, of course.

    It's not compulsory to have your residence card in your new passport. You can carry the old passport with the residence card and the new passport.

    You only apply again IF YOU WANT to. You don't have to!

    is there a law that says this?
    from what i have always understood an expired passport is expired regardless of what you have in it. so please point me to the right direction.

    You can carry 2 passports if you wish.

    I have received an email back from the IND regarding this.

    You can

    1) travel with both passports
    2) send in your passports to them to get a transfer (I know the website states otherwise).

    Personally, I can't be bothered to go without my passport for 6months again, so I travel with both passports.....

    Just a last word on visas/permits and passports in general.

    If you have any endorsements/permits/clearances/visas on an expired passport and you have a new one, you are by law required to travel with both passports, more so if you are not transferring endorsements/permits/clearances/visas on the new one.

    If it's one or two of these only, it's less of a hassle and you can re-apply for them and have them appear on your new passport, though you are NOT required to by law. This is a personal choice.

    As long as these entitlements are valid and current, then their status remains, despite being on expired passports, as long as you travel with the new one.

    Thaks to all those who took time to share their knowledge. So, the final outcome is :-

    If i have old passport with a longer residence stamp than the expiry date of passport, that is considered OK for travel as long as i travel with the new valid passport. It does not matter if the new passport hasn't got any stamp as long as it is accompanied with the old passport that has endorsement.

    Is that the conclusion ?? please do suggest.


    Also, please do inform if i need to transfer Residence stamp to new passport , do i reallly have to re-apply and wait again for 6 months or so ??
