    I'm the EEA 8 and my husband is non/EEa and came to UK 2 month ago.
    We are married for 8 years and we have 3 year old child. Before we lived in my husband country all this 8 years.
    We got Family permit easily and came to UK.

    Now i have questions, if somebody can give advice:
    Until now we didn't submit any forms to the HO(maybe its too late already?). My husband family permit expires in October.
    We like to submit all together-EEA1& EEA2.
    My husband found work and working 1 week now.
    Is it possible, that i will apply myself as self -sufficient person? I cant go to work now cos of the child. But my husband didn't get any payslips yet ?
    What is the poof of funds??? My husband has some savings in his home country bank, is it ok?
    Maybe later i will look for a work also when we are more settled and child going to school..but how the HO will know that i will look job later and will not remain as self sufficient person?

    I suggest you apply together , once your husband have a steady job and you think all the relevant documents are in order.

    Could anyone pls answer the question about the sufficient funds-

    If my husband has minimum salary, is it enough for the HO that im self sufficient? My husband has some savings in his home country bank, is it ok or we have transfer all the money in the bank account here?


    Also, do i need NI number if I´m not working yet?

    Kamila I do not have an answer for you (I'm sure somebody else more expert will, thou) but instead I do have a question to ask you:
    I read that your husband found a job even BEFORE applying for a Residence Card (EEA2).
    That makes me think that for his employer the Family Permit stamped on your husband's passport was enough, is that correct?
    I read all the stickies and threads on this forum about this topic; especially the ones from polkasweetie and tripleH that say that a Family Permit should be enough, but I also read kjfaughnan's posts on the same sticky (http://www.easyexpat.com/forums/ftopic_5958-0-asc-20.htm) of November 2005 saying that even if he was offered several jobs he could not accept them because all the employers asked for a residence card.
    Now I'm wondering if kjfaughnan just had bad luck or maybe it's something that used to happen in the 2005 (when kjfaughnan wrote) but now employers are more flexible and accept family permits too...
    The reason I'm asking is because my partner (American) and I (Italian) - both currently living in the US -are thinking to relocate to the UK and enter the country at the same time with a Family Permit.
    Since my partner is pretty skilled and his first language is English, we thought he could get a job much quicker than me.
    But if instead a residence card is usually required by employers to hire a non-EEA that will be a problem!
    It would be great to hear the experience of non-EEA that were hired recently just on their EEA Family Permit .

    I found something from Ho homepage:

    Family Member Residence Stamp

    If you are a national of one of the 8 relevant Accession States i.e. the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Slovakia, and Slovenia (Cyprus and Malta are exempt), and you are in employment your non-EEA national family member(s) will not be eligible for a Residence Card unless you have completed 12 months continuous employment in the United Kingdom and are eligible for a Registration Certificate. However, if you have registered under the Worker Registration Scheme your non EEA national family members can apply for a family member residence stamp.

    It means, that my husband cant get the family member resident stamp if im not working? Can he still have a job???
    But i wanted to apply myself as self sufficient person...how this will work?

    Can anyone advise? :idea:

    But is your husband already working or is he not??
    Did the employer ask for his Residence card or the EEA Family Permit stamped on his passport was enough?

    The Family Permit is enough to work and before 1 month the Family permit expires he has to fill EEA2 form, also you have to fill EEA1 form, better to send them together to the HO. :rolleyes:

    The right to employment is inherent in the fact that you are married to an EU citizen. The Family Permit itself is more than enough to show the employer that you are eligible to work here, not because the family permit states that, but because one was issued a family permit, this then goes to show the individual is a recognised family member of the EU national, as recognised lawfully by the Home Office. Employers who are seeking an EEA residence stamp in the passport are being ignorant of the law. Speak to the HR of the company and bring your marriage certificate and direct them to the Home Office website and let them do their own reading, as they should be aware of these matters.

    Kamila:
    For your applications, since your husband has only started work recently, in lieu of payslips, he can obtain a certificate of employment from his employer (usually given by the HR department) and this should be enough proof regarding your husband exercising treaty rights to be issued the residence card.
