✎ EN Working overstayer returning to US to marry and return

    I have looked through a lot of posts and haven't been able to find any answers to our problem.

    My fiancee and I are going to Texas at the end of August to get married and apply for a spouse visa to return to the UK. I am a British citizen renting a private apartment and have a steady job so there is no problem with me.

    The problem is with her status. When we met she was an overstayer. SHe had come over to work as a nanny and the family had said there was no problem with her visa, or didn't need one. Since then she has been working cash in hand.

    My question is that on the application form they ask about any previous visits to the UK and duration. Obviously we want to be as honest as possible so they would pick up she has overstayed from this. But do we need to mention that she has been working? Any ideas how this will affect the application? I have seen other posts saying that the Immigration Officer didn't seem that bothered about the overstay time! Maybe they were just lucky?

    Any help would be great.

    So you would recommend being totally honest? That's what we have been told by a couple of other places.

    Should we bring up the bit about working though? There is no clear part on the form where to mention this?? Again there is no place to mention about the overstay? They ask about any previous visits to the UK so would obviously pick it up from here, but don't ask for any explanation.

    Should we try to prove to the Officer that she has worked so can support herself and just wants to be legal?

    No,I did not suggest that ;)

    I did not get this one.Working where?If she was working illegaly that wouldnt be such a good idea.

    Would it be best to say that I have been supporting her?

    I'm guessing they will ask how she has been living in the UK for so long?

    How long she overstayed.?
    If you are not sure what evidence to provide,{IF ANY},(keeping in mind that she was working Illegally)I`d suggest you have a chat with solicitor.
    If you dont want to mention evidence that would kind of incriminate her I wouldnt recommend a solicitor.
