    I've applied for FMRS in September 2006 because my husband hasn't fulfilled the requirement of "to work for 12 months "to be eligible for residence card permit .
    In about 6-8 months i got a letter saying -I'm not eligible, but i could be considered for a residence card.
    I don't mind if i get residence card instead of FMRS.
    But i just wanted to be on a safe side-Is everything going well?Will they not refuse my application at all in the end?
    What could be the reason for me not to be eligible?

    Did they ask you to provide more documents?What did letter say?

    Thanks for taking time to look at my question.
    It says"You have applied for a Residence stamp as a family member of a person required to register under ASWRS.Unfortunately,you do not qualify.However,you can be considered for a Residence card."
    Yes they asked for a letter from the employer to confirm he is still in the employment . And we've send it to them.
    We didn't get the conformation letter that they've received it thou.
    I just got worried and confused that they said -I wasn't eligible for FMRS but could be considered for a residence card? :rolleyes:

    I'm about to be in the same boat.

    My partner went to England from Poland under the CIS card so he didnt have to apply for WRS. After 12 months, he switched to paid employment, and was advised he didn't need WRS

    So I spoke to the british consulate in Australia about applying for a Fiance visa, and they said he needed a residency certificate for me to qualify. So when we went to get the residency form it asked if he was under CIS or WRS for the basis of his residency. I rang and asked which category he should sign under. No-one knows if he needs to be on the WRS, not even the WRS advisors, but then suggested he should for his own benefit, So My partner is now doing that, and he cant qualify for residency for another 12 months because of the immigration departments bungle.

    I don't qualify as a fiance. Oh, joy, I can apply for a visit to marry visa, then I fly to the other side of the world, get hitched, and then have to fly back to Australia to apply for the FMRS. (do these departments even know what kind of grief they are putting couples through???)

    I said to him "bugger it, why don't you just fly over to NZ and we can get hitched there? it will cost about the same, but with a lot less paper work and at least we can have a holiday at the same time"

    So thats what we are going to do, and then I'll apply for an FMRS or an EEA or whatever bloody paper they invent next week to screw up my love life...

    In the meantime, we are both miserable, and on opposite sides of the planet. I was much happier when I was living with him in the UK before my working holiday makers visa ran out... *sigh*

    Will I have to wait 6 months for a reply about the FMRS???? If thats the case that will be almost a year apart. Why do they put us through so much suffering???

    I'm so sick of being in tears over it. I miss my partner terribly.
