✎ EN EEA permit - tourist visa expiry

    Hi

    BACKGROUND INFORMATION:
    Details:
    Me - Australian national
    Partner - Spanish National
    status - Unmarried but marrying on 1st of july

    my Tourist visa that I am currently on is expiring at the end of next month. My partner is living and working in the UK. We have been hanging out and doing a bit of traveling around the UK on weekends and holidays.

    We have decided to take the next step and finally tie the knot after 3 years of going out.


    THE PROBLEM:
    my tourist visa will run out in the end on july as I mentioned. We have already booked our holidays/honeymoon to germany and spain in August/september. The EEA family permit takes up to 6 months to process. I have heard that you can give a certified photocopy of your passport with the application thus allowing you to travel (stamp put into passport at a later time). but if I travel will I actually be allowed back into the country?

    QUESTIONS:

    1. Can anyone confirm that they have handed a certified copy of thier passport into the Homeoffice?

    2. Assuming I can hand in a certified copy of my passport and then go on our holidays, when I go to return into the UK from my holidays will I be allowed in?? (remembering that as an australian i am allowed 6 months stay in any 12 month period and by that time my visa would have expired)

    3. what proof should I bring to the immigration counter? any tips

    4.Has anyone out there ever rocked up to the immigration counter with a marriage certificate and their partner?


    I would really appreciate if anyone could help me on any of these problems.

    I think you mean EEA2 residence.There is no Family Permit within UK.
    You could always get one while on honeymoon.
    My wife was recently issued one within 48 hours.

    Can you tell me more?

    I must be misunderstanding things on the recent forum topics. I thought after we are married we apply for a EEA1 (her) for a EEA2 (me) family permit (take 6 months).

    How is this different to a residence card?? does a residence card allow me to work? which form do I use? please clarify further

    All the applications forms are here.
    EEA1 and EEA2 for you two.(within the UK)

    Family permit is entry clearance before comming to the UK.You may not need one,you are non-visa national.If you get one prior to comming to UK,you may be able to work.Read all the info at the top of the page.

    Thanks for the reply. So I am still unclear about 1 thing. I have read on a number of different posts that EEA2 residence cards can take 5-6 months

    Im not sure if terminology is getting mixed up here between residence card and family permit (which could be causing my confusion).


    you mentioned 48 hours? did you apply at an Overseas embassy? 48 hours surely couldnt be at the croydon home office could it? May I ask for further details of how you managed to get your wifes so quickly.

    Yes, that takes 6 months.

    Family Permit is entirely different thing.

    Yes, I applied outside the UK.You cant apply when in the UK.

    It shouldnt take long for anyone.She is resident in another EU country.The whole process was just formality,and it should be for anyone,not just her.

    ok, thanks Triple H. that helps to clarify things a bit. It seems I am after the EEA residence permit then. So going back to my original questions do you or anyone have any insight into them.

    Bring your marrige certificate with you , your wife should be there with you , just in case.

    Yes, you can do that. Even a normal copy worked for me, because they will need the passport anyway to put the sticker in. But that is only necessary once you have made it through the backlog queue.

    This is a difficult question, and I just had the same problem. The most likely answer is yes, no problem. You can apply for an EEA family permit abroad to be sure. It is still unclear to me how this works if you are only visiting, and what kind of documents you need.

    Your marriage certificate, your spouse and both passports should be enough. A proof of address and proof of cohabitation (e.g. a shared utility bill) would be perfect, but probably not necessary. A bank statement with enough money in the account may also be helpful.

    No, we just got another tourist visa in this situation. The funny thing is that once you are married, you have the right to live in the UK, but you don't have the right to enter the UK without the residence card.

    So you should apply for a residence card as soon as possible (as soon as you are married). The form is EEA2, and if you send it together with an EEA1 application, it gets processed a bit faster (2 months instead of 6).
