✎ EN Polish in UK before 05/2004

    hello everyone
    i'm polish citizen living in uk since may 2003 which iss exactly one year before poland joined eu. when i first came to uk i was granted tourist visa.

    for these 6 months i was living with my british partner. before my toourist visa expired i bought 6 months language course and wen tback to poland for two weeks.when entering again,although having confirmation letter from school,sufficient funds and a letter from my partner, i was granted tourist visa again. :evil: :( :eek: :eek:

    i satyed for another month and we boought another 2 months in language school.i went again to poland,came back but this time with student visa in my passport-january 2004.

    from that time i was able to take up employment. in june 2004 i registered with WRS scheme when i changed jobs although as far as i remember i didnt have to at that time.

    after 12 months i apllied using eea1 form for residence which was granted for 5 years.

    at this time i am thinking of applying for permanent residence on eea3 form but the probllem is i can only prove i have been here from january 2004 when i had my first payslip.

    they require prove for 5 years.if all the time i was in uk was included in this 5 year time i could apply in may 2008, but if not is it january 2004 when i had my student visa and first payslip or is it when i applied for residency on eea1 form?

    how can i prove them i was economically self-sufficient from may 2003 to january 2004?will it make any difference that poland wasnt eu member in 2003?

    ill be gratefull for any help

    Rules for permanent residency

    acording to the European Regulations the time you spent in the UK before 1st May 2004 does not count towards setlement because you had turist and student visa, and those categories alone did not entitle to apply for permanent residence when Poland was not yet part of the EU.You will have certainly aquired the right of permanent residence after 5 years of exercising European Treaty Rights on your EEA1 residency.
    I am not sure how will be treated your year under the WRS.
