✎ EN Getting married......or not?

    Hi, my boyfriend just came back from his country(Albania) with his visa, we wanted an unmarried partner visa but they didn't want to give it to him so insteed he got the fiancee visa wich means that we'll have to get married. We've been toghether for nearly 4 years but nether of us want really to get married, is it any way to get the leave to remain without getting married??
    If finally we do have to married........what is the next step? I'm gessing we would have to apply for a family permit or something like that but i need help to know exactly what to do

    Hi, I've been looking in the homme office website but I can't find anything that explain what to do about getting married and what to do after, the only thing i found is this:
    Use Form COA to apply for a certificate of approval for marriage or civil partnership if you wish to marry or register a civil partnership in the UK. If your leave to enter or remain in the UK was for 6 months or less and/or you now have less than 3 months leave remaining, you should also download the leaflet COA applications - Important information .

    The certificate will allow foreign nationals with limited leave to remain in the UK to notify a registrar that they intend to marry in the UK.

    If your application for a COA is granted, this does not give you leave to remain in the UK. For more information, please see

    hi is me again, i've been doing some research on the home office website and i think ones we get married we need to apply for the EEA2, correct me if I'm wrong please,
    Now i just need to know if we can get marry anywhere cause somebody told me that there are special registery ofices for visa marriages, any idea about this? please help!!!!!!!!!!

    hi- sorry it's not perfectly clear whether you're a UK citizen or not? If you are, and you and your partner are getting married, and he already has a UK fiance visa, once he's in the country just go to your local registry office (depends on what borough/city you live in) with your passports and proof that you've both been at your addresses for at least seven days.

    Just bring in two seperate pieces of mail, one with your name on it and one his, and your passports - his with the fiance visa in it (unless you can show proof that he has clearance to marry in the UK, they won't register you). Both of you need to attend the registration. Then register and set a date for your wedding - it just has to be at least 15 full days after you register.

    If you live in different boroughs, you each have to register at your own office.

    I assume the procedure is similar for non-UK EEA nationals marrying non-EU people.

    Your partner will only be able to reside in the UK for the next 6 months on the fiance visa, and also not be able to work.

    Have you lived together for 2 years or more continually and have the paperwork to prove it? If you do then you may be able to apply for the unmarried spouse visa which would allow 2 years of tempoary residence (like the one you would have to apply for if you got married), in that time your partner could work but not have access to public funds

    After two years you can then apply for perment rights to remain as long as you again have all the neccessary documentation that proves the two of you have been living together

    Hi thanks for ur answers but there's something i don't undestand......ones we have register at the registery office will they give us the marriage certificate so we can apply for his EEA2? cause we don't want a church wedding or nothing like that, we'll do that properly later on. Sorry i don't know much about weddings and it's paperwork

    Just to clarify I'm spanish and he is albanian, we've been living together for 3 and 1/2 years, we wanted the unmarried partner visa in the first place but they didn't want to give it to him

    Hiya-
    Okay - I'm a non-EU marrying an English boy, but I think this will work the same for you:

    When you register, you're just declaring your intent to marry. It doesn't make you legally married at all, and so you cannot apply for any change in visa status until you're actually married. You can sign up for a time slot to get married in the registry office when you register (in fact, you can't book a registry office ceremony UNTIL you register).

    The marraige will have to take place 15 days or more after you register (it costs a total of £60 to register, and £43.50 for the ceremony).

    THEN, once you're married (and have the paperwork to prove it!), you apply for the change in visa status.

    Hi,

    I just read this topic and I have nearly the same "problem".

    I already knew what to do and we (I and my bolivian girlfriend) are having all the documents and Visa, who you need for a marriage.

    There is only one question left after I read all the messages here. We are living in the Republic of Ireland but we wanna marry in nothern ireland. I have an approval about my residence here in Dublin, but not in nothern Ireland. So, I have to stay there for 1 week until we can marry??? It's just because we want to do it without spend a week in a Hotel when our house is just 2 hours away from the town....

    I would be glad if anyone could answer me this question.

    I don't think that will be possible Roman. Northen Ireland and the Republic of Ireland are 2 seperate countries. Being on a visa and entitlement to marriage in the republic of Ireland doesn't mean you will have the same right in Northen Ireland
