I am currently living in England and will be marrying my American fiance in her country in February 2007, (my fiance is currently living in the USA) once we are married, would that entitle my (future) wife to immediate access to live and work here in England?.. if not.. what does my future wife have to apply for and where does she apply for the things she may or may not need?..

    kind regards..

Your fiancee will need to apply for the spouse visa AT THE BRITISH CONSULATE assigned to her state (the consualte may be inconveniently located 1200 miles or more away), and get it BEFORE entering the UK. She cannot get it at border control, and could be denied entry to the UK if she tries to ener without it.

You can apply by mail, but she will need to send her passport in, so she won't be able to travel til she gets it back. Or you can make an appointment and go in person - the person at the consulate will ask her a few questions about your relationship (they're not too bad :) )and show some proof of your relationship (ideally, some photos of you two together and some other proof just to be safe) and proof of your marriage; from walking in to being handed her visa takes about an hour.

If you do make an appointment, make sure to do it several weeks in advance to make sure you get the date/time you want.

(you can only get the FLR(M) visa from inside the UK if you already have another type of settlement visa, ie a fiance/fiancee visa).

dude, dont bother in moving to the states. my husband is english and i am american. we went through the same thing that you are going through right now. YOU NEED A VISA TO LIVE IN THE STATES!!! getting married wont give you that. it wont entitle you to live automatically in the states. It would be much much easier for her to move to England. I had my visa in 4 days to come to england.
