So, you applied for ILR and still waiting?
How long are you waiting, did you hear from them?

If you apply for UK residence under EU law it would take 5 years to get ILR,if you are still married. You`d be considered as dependent of EU citizen.

It would make sense to me to wait for your ILR if possible.Once you make new application under EU law if Iam correct your application for ILR would be no more valid.

    Do you mean legally?
I am not sure but I think NO!
IF you switch to EU dependant you would come under EU law not the UK.
As I said , makes no sense to apply for EU dependant residence if you have possibility of getting ILR.

You can ask here here as well.

A friend of mine has came in UK in 1998 as asylum seeker, and got ELR
for one year and been waiting since then
But las year he had some fight and has been in prison for a year
on end of this month is about to finish his sentence
but the homeoffice told him to go back to his country and to entry the UK
    for whole his life.
He has been living with his girlfriend together for about 4 years.
They going to get married after he finish his sentence.

is it gonna effect what the homeoffice told him on his family permit
or is only if he clam asylum seeker?

can some one give some inf about this cos i just heard about this
he so worreid. he dosen't to get separate from his girl friend.

    thank you

The best thing is to ask solicitor.I dont know how his criminal record would affect any application.
