    Hi I wonder if anyone can help me here,

    I am a non EU National currently married to an EU Natioanl. We have been together for over 5 years. I am not happy with my marriage and thinking of a divorce because I want to leave her to marry another who is British.
    I understand this is complicated but I need to know if this is possible because i cannot live without my new finance

    Sorry i should have put these before:
    I am a Nigerian citizen and I have lived tin the uk for almost 10 ten years all legally, 6 as a student and the remaining as a family member of Spanish Nationality and is understanding).
    My brtiish partner keeps pushing me wanting to sort this out but i do not know where to start

    My guess is that you can divorce and remarry.
    How long your permit is for?
    You could even apply for ILR if you completed 10 years in the UK.

    My current visa is valid til end next year (i am currently on a 5 year family permit with my EU Partner).
    I do not want to remain with my EU partner in convinence. Is it possible to divorce her and apply for a residence permit independently, or would i have to go through another process when i marry my British partner

    I dont think you can do that!

    Thats the way to go.
    You qualify for ILR after living 10 YEARS lawfuly in the UK.

    Thank you for that, i was also told that since i am married to an EU national i would not qualify to apply for the permanent residence after 10 yrs and i have to apply as a family member for this.
    If i apply for a permanent residence as a family member i will be issued a semi permanent one for 10 yrs as a family member. I am not planning on staying with current spanish (because my britsh girlfriend and I want to get marrued) hence why i am confused.

    You could be right.
    But, it says 10 years lawful = ILR.
    Maybe in your circumstances you can`t do that.
    Strange :confused:
