✎ EN Does Spain recognise a cohabiting relationship?

    I am a UK citizen and have a Thai girlfriend who I have known for 26 months. We are living together in Thailand but want to live in Spain to start a business. I understand that a settlement visa can be obtained for the UK if a couple have lived together for 2 years. I have searched the net but cant find the answer to my question which is,,

    Does Spain recognise a cohabiting relationship in the same way that the UK does in order to apply for settlement in Spain for my girlfriend as a couple living together? Any help would be appreciated.

    The best option as always is to contact the Spanish Embassy/Consulate in the country you wish to apply from.

    From what I know though, Spain does not have anything like that in place. The ´reunificatioon´visa is only given to family members, described as - the spouse and descendants of these persons dependent on them, as well as the dependent relatives in the ascending line of the person and their spouse.

    In case you don´t know this already, the website for the Spanish Embassy in Thailand is -http://www.embesp.or.th and the one in London is http://www.conspalon.org

    The Regulations provide for a wider definition of "family member", to include a partner with whom the EU citizen has a durable relationship, duly attested

    I dont know how this works in practice but according to these new directives as from 30/04/2006 (all of EU),you could apply on the grounds that you have been in relationship akin to marriage for period of 2 years or more.
    How Spanish in Bangkok would look at your particular circumstances I really dont know.

    Thanks for your replies. I have read the link regarding family members but have a question relating to where it reads,

    QUOTE

    "Member States may require the following documents to be
    presented:
    (a) a valid identity card or passport;
    (b) a document attesting to the existence of a family relationship
    or of a registered partnership;

    (c) where appropriate, the registration certificate of the Union
    citizen whom they are accompanying or joining"


    In (b) above, any idea what document they would require and who from to prove our relationship? Also where it reads,

    QUOTE

    (c) the partner with whom the Union citizen has contracted
    a registered partnership, on the basis of the legislation
    of a Member State, if the legislation of the host Member
    State treats registered partnerships as equivalent to
    marriage and in accordance with the conditions laid
    down in the relevant legislation of the host Member
    State;


    In (c) above, does anyone know if,, The host member state, Spain in this case, recognises registered partnerships?

    Household bills,bank accounts in both names linking you to same address as a proof that you have been living together.

    As far as I understand relationship akin to marriage should be recognised by all member states.
    For instance, Irish have implemented it on the 1st of may 2006

    Saying all this , if I was you I wouldnt go for it.

    Registered partnerships in this case refers to same sex partnerships.

    Like I said before, I don´t think Spain recognises co-habiting, because before anyone from a non EU country is issued a permit based on their relationship with an EU citizen, a ´Libro de familia´ (if married to a Spaniard) or a current marriage certificate (not older than 3 months) must be presented when applying for the reunification visa and also when applying for residency in Spain.

    This is what I know for sure, because I have been through that process (after this legislation came into place). Every EU country inteprets the regulations in their own way, so I don´t know how this new legislation will affect your application.
